answer text <p>The Crown Prosecution Service (CPS) guidance on secondary liability (<a href="https://www.cps.gov.uk/legal-guidance/secondary-liability-charging-decisions-principals-and-accessories" target="_blank">Secondary Liability: charging decisions on principals and accessories | The Crown Prosecution Service (cps.gov.uk)</a>) provides guidance to CPS prosecutors on what needs to be proved in respect of the secondary party’s participation in an offence.</p><p>The secondary party, by words or conduct, must encourage or assist the commission of the offence by another person, and must intend to do so.</p><p>Mere accidental presence at the scene of an offence or mere association with the principal offender or a group or gang will not alone be sufficient to prove that a secondary party participated in the offence.</p><p>If the offence requires a particular intent, the secondary party must intend to assist or encourage the other person to act with that intent.</p><p>The CPS guidance provides a number of scenarios to demonstrate the type and level of participation that may amount to assistance or encouragement.</p><p>The guidance also contains a section on intent (see “Mens rea – Intent”) that explains in detail how intent may be proved in practice, in relation to various types of scenarios.</p>

answer text <p>The safety of students and staff across the education estate remains ministers' highest priority. Since the Grenfell fire, the department has worked closely with the Ministry of Housing Communities and Local Government (MHCLG) on fire safety. In line with that cross-government approach, we identified university-owned residential buildings over 18 metres with potentially dangerous ACM cladding. In the light of updated building safety guidance for owners of residential buildings published on 20 January by MHCLG, the department will gather any additional information required on residential buildings across the education estate, and will continue to work with building owners to ensure that any subsequent remediation work, if any, is undertaken.</p> more like this

answer text <p>Tower blocks that are currently under construction or are due to begin construction will be subject to Building Regulations. As such their design will be assessed and then the work will be inspected by independent building control bodies. The Department has commissioned and published the results of a series of BS8414 external wall system fire tests in order to improve the evidence available to developers and building control bodies in determining reasonable compliance with relevant Building Regulations.
