answer	answer is ministerial correction date of answer 04/11/2020 answer text <p>The Driver and Vehicle Licensing Agency (DVLA) has robust processes in place to ensure compliance with the rules governing the processing of personal data included in the General Data Protection Regulation (GDPR) and the Data Protection Act 2018.</p><p> </p><p>The implementation of the GDPR required no specific changes to the robust controls already operated by the DVLA in relation to the lawful sharing of data with authorised third parties. The law allows vehicle keeper details to be disclosed to third parties, including private parking companies, who can demonstrate that they have a reasonable cause to receive it, and any charges levied are to cover costs of processing requests.</p><p> </p><p>The DVLA’s privacy policy is available online at: <a href="http://www.gov.uk/dvla/privacy-policy" target="_blank">www.gov.uk/dvla/privacy-policy</a> and provides data subjects with detailed information on who the DVLA shares information with, rather than contacting individuals whenever information is shared. The Department for Digital, Culture, Media and Sport does not hold operational data on the Information Commissioner’s Office’s (ICO) enforcement activity and is unable to to provide detail on specific complaints or investigations on behalf of the Commissioner. The ICO does, however, publish a range of management information about enforcement activity they have undertaken and numbers of complaints received and addressed on their website (ico.org.uk). answer	answer is ministerial correction date of answer 12/11/2018 answer text <p>The arrangements governing the release of Driver and Vehicle Licensing Agency (DVLA) data aim to strike a balance between protecting personal data and allowing vehicle keepers to be contacted by those with a legitimate need to do so.</p><p>The law allows the DVLA to release vehicle keeper details to third parties who can demonstrate that they have a reasonable cause to receive it. The release of DVLA’s data is subject to a formal assessment to ensure that there are adequate policies, procedures and technical controls in place to protect it. Data Protection Impact Assessments are completed to identify and address any privacy risks and ensure that personal data is only processed in compliance with the law.</p><p> </p><p>Recipients of vehicle keeper information must handle the data in accordance with clear terms and conditions. Where recipients pass the information onto another company, there must be a formal contract in place to provide assurance over the use and security of the data. The original recipient retains overall responsibility for the use of the data by its sub-contractors.</p><p> </p><p>The DVLA carries out its own comprehensive audits, involving both remote and on-site audits in conjunction with the Government Internal Audit Agency. This helps to ensure that information provided by the DVLA is used only in accordance with its terms and conditions. These measures vary depending on the service used and the sensitivity of the data provided.</p><p> </p><p>All DVLA’s data release services are subject to a formal assessment before they are made available for use. This ensures that there are adequate policies as well as procedural and technical controls in place to protect the data.
