answer text <p>The Government response to the “making flexible working the default” consultation was published on 5 December 2022. It sets out that the Government will make the right to request flexible working a ‘day one’ entitlement, by removing the existing 26-week qualifying period. This change will be delivered through secondary legislation, using existing powers in the Employment Rights Act 1996.</p><p>We are committed to introducing this change alongside the measures included in the Employment Relations (Flexible Working) Bill, which is currently progressing through Parliament.</p> more like this

answer text <p>The Government is pleased to support the Employment Relations (Flexible Working) Bill which will introduce a requirement for employers to consult with an employee before rejecting their statutory flexible working request. The Bill does not specify what form the consultation should take.</p><p>The Government will work with both the Advisory, Conciliation and Arbitration Service and the Flexible Working Taskforce to develop appropriate guidance on each of the measures that the Bill will introduce.</p><p>If an employer does not handle a request as required by Part 8A of the Employment Rights Act 1996, an employee may be able to bring a claim to an Employment Tribunal.</p> more like this

answer text <p>The Department for Business and Trade works with a number of other Departments to promote flexible working. Several of them are members of the Department for Business and Trade / Chartered Institute of Personnel and Development co-chaired Flexible Working Taskforce, alongside business and family representative groups. In December 2022 the Government announced plans[1] to make the right to request flexible working a day one right, alongside other changes to make flexible working more accessible to all employees. The response commits to a range of measures that will help to maintain and increase acceptance rates. These include:</p><ul><li>making the right to request flexible working a day one right;</li><li>introducing a new requirement for employees to consult with the employee when they intend to reject their flexible working request; and</li><li>allowing two statutory requests in any 12-month period (rather than the current one).</li></ul><p> </p><p>The response also commits to developing guidance on how to make and administer temporary requests for flexible working.</p> more like this

This committed to make a number of changes to the existing Right to Request Flexible Working, including making it apply from the first day of employment. It also committed the Government to issue a call for evidence on non-contractual and ad hoc flexible working. answer text <p>In September 2021, the Government published a Post Implementation Review of the 2014 Flexible Working Regulations. This considered evidence from a range of different sources, including the Management and Wellbeing Practices Survey.</p><p> </p><p>The survey found that in 83% of workplaces, where a request had been made, the request was granted, with 9% of employers reporting turning down a flexible working request in 2018-19 (the remaining proportion had an unknown outcome). These numbers remain broadly unchanged since the right to request flexible working legislation was extended in 2014.</p> more like this
