There are a number of different legal provisions that provide a maximum period for the charging of a suspect in England and Wales, but those periods do not usually run from arrest and they only apply in certain cases. In other cases, there is no set time limit from arrest to charge but the courts do have the power to stop a case as an abuse of process if there has been such delay as to make it unfair that the proceedings should continue.<\/p>

<\/p>

The decision to charge is made by the police in some cases and by the CPS in other cases. The CPS make the decision to charge in serious cases but over the last five years the police have made the charging decision in 61% to 63% of the cases that are prosecuted by the CPS.<\/p>

<\/p>

The most significant time limit for the charging of criminal offences is contained in section 127 of the Magistrates\u2019 Courts Act 1980. That provides that summary-only offences must be charged within six months of the offence (not arrest) unless there is any special provision made for that offence. Those special provisions are limited; some provide for longer periods for certain offences and some provide for periods that only start once evidence of an offence comes to light.<\/p>

<\/p>

There are also time limits contained within the Police and Criminal Evidence Act 1984 (PACE) that limit the time a suspect can be kept in custody after arrest. That can provide a time limit for the charging of cases when the police seek to charge and keep a suspect in custody for a court appearance. As a consequence of the time limits contained in PACE, decisions as to charge in those cases have to be made swiftly (the usual time limit is 24 hours, but more time can be available in some cases). For that reason, the CPS has prosecutors working 7 days a week, 24 hours a day to make charging decisions in those cases.<\/p>

<\/p>

In other cases, in which suspects are released with or without bail (also known as released under investigation) there is no general cross government guidance on a maximum period between arrest and charge.<\/p>

<\/p>

Timescales for charging decisions made by the police are a matter for policing. In cases in which the CPS make the charging decision, the CPS and the police have agreements in place that set a timetable that can change depending on the circumstances of each case. There will be cases in which the CPS cannot make a charging decision on the information provided and the case has to be referred back to the police for further investigation and a submission back to the CPS at a later date. The government knows that the labour market is continually changing along with the demand for skills. We welcome Dr. Marshall\u2019s request for employers to invest more in their training. The government is working with employers to design and deliver a skills system that is more responsive to their needs. We are taking steps to increase the supply of science, technology, engineering and maths (STEM) skills by supporting new institutions such as NMiTE, a new engineering university in Hereford, and the Institute of Coding, where a consortium of employers and universities will ensure Higher Education courses meet the needs of the economy. We are also funding interventions such as the Stimulating Physics Network and the new Level 3 Mathematics Support Programme to improve the standard of STEM education and engage more young people in these subjects. In 2017, there were 35,000 more entries to STEM A levels compared to 2010, an increase of 17 percent.<\/p>

We are supporting the Institute for Apprenticeships, an employer\u2013led body which is leading the development of apprenticeship standards and assessment plans. From April 2018, the Institute will assume responsibility for T level standards. 214 new employer-designed apprenticeship standards are now ready for delivery, with over 300 more in development. Take up of higher-level apprenticeships in 2016/17 was up by nearly 35 per cent compared to 2015/16 and there were 24,600 apprenticeship starts in 2016/17, increasing from 4,300 the year before. Before Christmas, over 3,000 higher and degree apprenticeships from over 40 high profile employers were being advertised.<\/p>

We are introducing an ambitious \u2018National Retraining Scheme\u2019 to boost adult learning. This will bring together government, businesses and employees through the Confederation of British Industry and the Trade Union Congress. A set of sector-focused and employer-driven initiatives starting this year will target immediate skills shortages in key sectors, with £64 million for construction and digital skills.<\/p>

Skills Advisory Panels (SAPs) will help align skills provision with local employer demand. The first seven SAP areas are West Midlands, Greater Manchester, Lancashire, Leeds, Greater Lincolnshire, Thames Valley Berkshire, and Cornwall & Isles of Scilly.<\/p>

We are encouraging a high quality, viable and resilient Further Education sector comprised of a range of providers, capable of attracting outstanding teachers and leaders to deliver these changes successfully. The department has committed up to £500 million a year to support the delivery of T levels once all routes are available and announced an extra £20 million for colleges to invest in the workforce to deliver new T level qualifications.<\/p>

The department is also investing in new Institutes of Technology and supporting National Colleges to address the need for specialist skills.
