In October 2019, His Majesty\u2019s Government announced its decision to use the Online Safety Bill to protect children from pornography. The provisions in this Bill will provide greater protection to children than Part 3 of the Digital Economy Act. It will cover a wider range of services, including social media companies and search services, which were not in scope of the Digital Economy Act, and which play a significant role in enabling children to access harmful content online.<\/p>


There is no statutory obligation to update the guidance mentioned in section 27 of the Digital Economy Act. As HM Government intends to repeal Part 3 of that Act through the Online Safety Bill, amending this guidance would not serve any purpose as it will not be used. Instead, Ofcom, as the independent regulator for the online safety regime, will set out the steps companies can take to protect children from harmful content such as pornography in codes of practice. Ofcom will also publish guidance for companies to meet the duty to protect children from published pornography in Part 5 of the Bill. The Secretary of State will also have a general power to issue guidance to Ofcom about the exercise of its functions under the Bill.<\/p>


Ofcom will have a range of powers to assess whether companies are fulfilling their duties, and will be empowered to enforce the new regulatory regime. In September 2019, NHS England and NHS Improvement published a revised version of the guidance on Delivering Same-Sex Accommodation<\/em>. The team are reviewing feedback received and considering further revisions.<\/p>

The guidance is clear that providers of National Health Service-funded care are expected to have a zero-tolerance approach to mixed-sex accommodation, except where it is in the overall best interest of all patients affected. There are some clinical circumstances where mixed sex accommodation can be justified. These are few, and mainly confined to patients who need highly specialised care, such as that delivered in critical care units.<\/p>

There are currently no plans to withdraw the guidance. The guidance is relevant to all patients including patients who have the protected characteristic of gender reassignment as set out in the Equality Act 2010. That is, a person who is proposing to undergo, is undergoing or has undergone a process (or part of a process) for the purpose of reassigning sex. The review will include consideration of whether the language used within the guidance needs to be clearer.<\/p>

NHS trusts have not been asked to provide the information required to make an assessment of the impact of allowing patients to self-identify their gender and there are no plans to ask them to do so. NHS England is currently undergoing a transformation of its commercial and procurement functions and, as part of this process, a need has been identified for improved contract management process and for the deployment of skilled contract management resources within the organisation.<\/p>

With regard to clinical commissioning groups (CCGs), NHS England has established a Lead Provider Framework Agreement for CCGs (and other public sector entities), providing access to commissioning support services, including procurement and contract management capability. NHS England\u2019s website provides a large number of tools, resources and \u2018how to use\u2019 website, all of which can be accessed at: www.england.nhs.uk/lpf<\/a>. The Lead Provider Framework provides access to nine accredited providers of commissioning support services who are already providing effective contracts and procurement support at scale to other CCGs and commissioners.
