The Home Office’s Non-Crime Hate Incidents Code of Practice on the Recording and Retention of Personal Data came into effect in June 2023 and applies to police forces across England and Wales. The code includes safeguards better to protect the fundamental right to freedom of expression and stipulates that police should only record NCHIs when it is necessary and proportionate to do so, and not simply because someone is offended. Incidents that are irrational, malicious, or trivial should not be recorded as NCHIs.

To address concerns about the recording of personal data, the code introduced an additional threshold to ensure that personal data may only be included in an NCHI record if the event is motivated by intentional hostility or prejudice and where the police judge that there is a real risk of escalation causing significant harm or a criminal offence.

The College of Policing publishes operational guidance for the police, known as ‘Authorised Professional Practice’ (APP), on how to deal with different types of crimes and incidents, including NCHIs. The College updated its APP so that it aligns with the Government’s code. The College is responsible for determining police training requirements, and has developed an e-briefing pack on NCHIs which is available to forces.

The code specifically covers characteristics that are protected under hate crime legislation in England and Wales – race, religion, sexual orientation, transgender identity and disability. It defines transgender identity or perceived transgender identity by setting out that “references to being transgender include references to being transsexual, or undergoing, proposing to undergo or having undergone a process or part of a process of gender reassignment.” This aligns with the definition set out in section 66(6)(e) of the Sentencing Act 2020.

The Home Office does not collect data from forces on the number of NCHIs recorded by the police, nor do we collect data relating to the personal characteristics of those involved in incidents. We similarly do not collect information on police spending relating to the investigation of NCHIs. The data collected from the police balances policy needs and the burden on forces.
"} , "answeringMember" : {"_about" : "http://data.parliament.uk/members/4503", "label" : {"_value" : "Biography information for Chris Philp"} } , "answeringMemberConstituency" : {"_value" : "Croydon South"} , "answeringMemberPrinted" : {"_value" : "Chris Philp"} , "dateOfAnswer" : {"_value" : "2024-01-17", "_datatype" : "dateTime"} , "groupedQuestionUIN" : [{"_value" : "8817"} , {"_value" : "8818"} , {"_value" : "8819"} , {"_value" : "8820"} , {"_value" : "8821"} , {"_value" : "8823"} , {"_value" : "8824"} , {"_value" : "8825"} , {"_value" : "8826"} , {"_value" : "8827"} , {"_value" : "8828"} , {"_value" : "8829"} , {"_value" : "8830"} , {"_value" : "8831"} , {"_value" : "8832"} , {"_value" : "8833"} , {"_value" : "8834"} ], "isMinisterialCorrection" : {"_value" : "false", "_datatype" : "boolean"} , "questionFirstAnswered" : [{"_value" : "2024-01-17T13:56:45.343Z", "_datatype" : "dateTime"} ]} , "answeringDeptId" : {"_value" : "1"} , "answeringDeptShortName" : {"_value" : "Home Office"} , "answeringDeptSortName" : {"_value" : "Home Office"} , "date" : {"_value" : "2024-01-09", "_datatype" : "dateTime"} , "hansardHeading" : {"_value" : "Non-crime Hate Incidents: Transgender People"} , "houseId" : {"_value" : "1"} , "legislature" : [{"_about" : "http://data.parliament.uk/terms/25259", "prefLabel" : {"_value" : "House of Commons"} } ], "questionText" : "To ask the Secretary of State for the Home Department, what definition of gender reassignment is used when recording a non-crime hate incident by the police.", "registeredInterest" : {"_value" : "false", "_datatype" : "boolean"} , "tablingMember" : {"_about" : "http://data.parliament.uk/members/4668", "label" : {"_value" : "Biography information for Rachel Maclean"} } , "tablingMemberConstituency" : {"_value" : "Redditch"} , "tablingMemberPrinted" : [{"_value" : "Rachel Maclean"} ], "uin" : "8822"} , {"_about" : "http://data.parliament.uk/resources/757814", "AnsweringBody" : [{"_value" : "Department for Transport"} ], "answer" : {"_about" : "http://data.parliament.uk/resources/757814/answer", "answerText" : {"_value" : "

The Government has not undertaken a formal assessment. While the Government acknowledges that any changes to arrangements for EU workers will be a factor in the availability of skilled staff for road haulage, it is not the only factor. As noted in the Government’s response to the Transport Committee’s report on skills and workforce planning in the road haulage sector, there are encouraging signs. For example there were about 10,000 more HGV driving test passes in 2015/16 compared to two years before, in response to the higher demand for HGV drivers and the shortages. In addition the industry has developed a new Trailblazer Apprenticeship standard for HGV drivers to be funded through the Apprenticeship Levy.
"} , "answeringMember" : {"_about" : "http://data.parliament.uk/members/3991", "label" : {"_value" : "Biography information for Jesse Norman"} } , "answeringMemberConstituency" : {"_value" : "Hereford and South Herefordshire"} , "answeringMemberPrinted" : {"_value" : "Jesse Norman"} , "dateOfAnswer" : {"_value" : "2017-09-13", "_datatype" : "dateTime"} , "isMinisterialCorrection" : {"_value" : "false", "_datatype" : "boolean"} , "questionFirstAnswered" : [{"_value" : "2017-09-13T15:01:28.883Z", "_datatype" : "dateTime"} ]} , "answeringDeptId" : {"_value" : "27"} , "answeringDeptShortName" : {"_value" : "Transport"} , "answeringDeptSortName" : {"_value" : "Transport"} , "date" : {"_value" : "2017-09-05", "_datatype" : "dateTime"} , "hansardHeading" : {"_value" : "Logistics: EU Nationals"} , "houseId" : {"_value" : "1"} , "legislature" : [{"_about" : "http://data.parliament.uk/terms/25259", "prefLabel" : {"_value" : "House of Commons"} } ], "questionText" : "To ask the Secretary of State for Transport, what assessment he has made of the effect of possible reductions in skilled immigration from the EU into the road-based logistics sector; and if he will make a statement.", "registeredInterest" : {"_value" : "true", "_datatype" : "boolean"} , "tablingMember" : {"_about" : "http://data.parliament.uk/members/3971", "label" : {"_value" : "Biography information for Charlie Elphicke"} } , "tablingMemberConstituency" : {"_value" : "Dover"} , "tablingMemberPrinted" : [{"_value" : "Charlie Elphicke"} ], "uin" : "8822"} , {"_about" : "http://data.parliament.uk/resources/416455", "AnsweringBody" : [{"_value" : "Home Office"} ], "answer" : {"_about" : "http://data.parliament.uk/resources/416455/answer", "answerText" : {"_value" : "

There was a significant change in the methodology used to record detections to the new outcomes framework introduced in April 2013. The new outcomes framework includes a broader range of “outcomes” for crimes dealt with by the police. This provides greater transparency on how crimes are resolved when compared with the former detections framework which only covered a subset of the new outcomes and, therefore, of the ways crimes are "resolved".

Information on the new outcomes framework and data for England and Wales were published by the Home Office in its “Crime Outcomes in England and Wales 2014/15” bulletin, alongside the number of outcomes in each police force area. www.gov.uk/government/statistics/crime-outcomes-in-england-and-wales-2014-to-2015

Figures for year ending March 2015 for England and Wales and the Metropolitan Police are shown in the table provided for all outcomes under the new framework. These show how crimes recorded in 2014/15 were dealt with. It is not possible to provide data for Kingston and Surbiton constituency as outcomes data are collected at police force area level.

Care needs to be taken when making comparisons of crime outcomes between police forces as different police forces use outcomes in different ways and will have a different mix of crimes to deal with. In addition, the figures for the Metropolitan Police are only available between December 2014 and March 2015, so a greater proportion of crimes from this more recent period will remain under investigation.
"} , "answeringMember" : {"_about" : "http://data.parliament.uk/members/1528", "label" : {"_value" : "Biography information for Sir Mike Penning"} } , "answeringMemberConstituency" : {"_value" : "Hemel Hempstead"} , "answeringMemberPrinted" : {"_value" : "Mike Penning"} , "attachment" : {"_about" : "http://data.parliament.uk/resources/416455/answer/attachment/1", "fileName" : {"_value" : "Table - PQ 8822.xls"} , "title" : "Table - PQ 8822"} , "dateOfAnswer" : {"_value" : "2015-09-11", "_datatype" : "dateTime"} , "isMinisterialCorrection" : {"_value" : "false", "_datatype" : "boolean"} , "questionFirstAnswered" : [{"_value" : "2015-09-11T14:45:54.857Z", "_datatype" : "dateTime"} ]} , "answeringDeptId" : {"_value" : "1"} , "answeringDeptShortName" : {"_value" : "Home Office"} , "answeringDeptSortName" : {"_value" : "Home Office"} , "date" : {"_value" : "2015-09-04", "_datatype" : "dateTime"} , "hansardHeading" : {"_value" : "Detection Rates"} , "houseId" : {"_value" : "1"} , "legislature" : [{"_about" : "http://data.parliament.uk/terms/25259", "prefLabel" : {"_value" : "House of Commons"} } ], "questionText" : "To ask the Secretary of State for the Home Department, what the crime detection rate was (a) nationally, (b) in London and (c) in Kingston and Surbiton constituency in the latest period for which figures are available.", "registeredInterest" : {"_value" : "false", "_datatype" : "boolean"} , "tablingMember" : {"_about" : "http://data.parliament.uk/members/4489", "label" : {"_value" : "Biography information for James Berry"} } , "tablingMemberConstituency" : {"_value" : "Kingston and Surbiton"} , "tablingMemberPrinted" : [{"_value" : "James Berry"} ], "uin" : "8822"} ], "itemsPerPage" : 10, "page" : 0, "startIndex" : 1, "totalResults" : 3, "type" : ["http://purl.org/linked-data/api/vocab#ListEndpoint", "http://purl.org/linked-data/api/vocab#Page"]} }
