The Government is dedicated to fostering the growth and global leadership of the arts and creative sectors, which significantly bolster the UK\u2019s economic prosperity, contributing 5.7% of the UK\u2019s total Gross Value Add in 2022 (£124.6 billion). They enrich people\u2019s lives, and play a vital role in presenting the UK as an attractive location to visit and invest.<\/p>
We are determined to improve the UK\u2019s trade and investment relationship with the EU by dismantling unnecessary barriers to trade. For the arts and creative sectors, this includes helping UK performing artists tour within the EU, enabling easier trade in the art, publishing and advertising sectors and facilitating greater cultural exchanges with the EU, as set out in the Government\u2019s manifesto and Creating Growth: Labour\u2019s Plan for the Arts, Culture and Creative Industries.<\/em><\/p>We have no immediate plans to conduct a formal review of the effect of leaving the EU on the arts and creative industries. Our focus is on working to reset the relationship with our European friends, neighbours and allies. The Prime Minister has had early positive early calls and meetings, including with European Commission President Ursula von der Leyen, and key leaders in EU Member States. The Minister for the Constitution and European Union Relations and the Foreign Secretary have also held early senior ministerial engagements with European counterparts, including at NATO and the European Political Community. Further engagements will be taking place over the coming weeks and months.<\/p>
We recognise that strengthening the relationship will take time, but this Government is ambitious and wants to move forward at pace, with clear manifesto priorities for the creative and cultural sectors.<\/p>

HMRC has taken steps to address the backlog of A1 applications, have achieved their recovery strategy ahead of time and they are now achieving service levels. Since September 2023 the processing times for online applications have decreased to 6 days from 15 weeks previously, and for post applications, it is now also 6 days, down from 33 weeks. The Bill applies to a broad range of public bodies to protect community cohesion and ensure a consistent approach to foreign policy. Specifically, the Bill applies to public authorities, as defined in section 6 of the Human Rights Act 1998. Bodies should already be aware if they are bound by section 6 of the Human Rights Act 1998 as this legislation has been on the statute book for 25 years and places wide-ranging obligations on them.<\/p>
The definition may include some arts organisations such as some museums and galleries in receipt of significant public funding when they are undertaking certain public functions. As with any general definition in legislation, there are instances where the application of a definition depends on the specific facts of a case and it is ultimately for the courts to decide.<\/p>

The Economic Activity of Public Bodies (Overseas Matters) Bill applies to public authorities, as defined in section 6 of the Human Rights Act 1998. There is no universal test to determine whether an authority is bound by section 6 of the Human Rights Act and therefore in scope of the Bill. However, indicative factors that have been identified by judges as relevant include: the authority receiving a significant amount of public funding; the authority carrying out acts in exercise of statutory powers; and the authority exercising a task which is in the public interest. Although there is no lower limit to the size of a public authority, nor the amount of public funding that a public authority can receive, judges have already clarified that receiving public funding does not, on its own, mean a body is a public authority under section 6, nor exercising public functions. Ultimately, the courts would decide on individual cases depending on the particular circumstances.<\/p>
