The UK will be leaving the EU on the 31 October - whatever the circumstances. We would, of course, prefer to leave with a deal and we will work in an energetic and determined way to get that better deal. But if that is not possible we will have to leave with no deal, and we are turbocharging our all necessary preparations to do so.<\/p>

In a no deal scenario, UK businesses will continue to be able to seek dispute resolution and redress through national courts, including those of Member States where they have jurisdiction. The route of redress and dispute resolution will depend on the particular facts of the case. Courts will continue to process relevant cases in line with their normal management of business, and relevant legislation.<\/p>

The Government is ready to implement sanctions if we leave the EU in a no deal scenario. It has laid Statutory Instruments (SIs) for 18 priority geographic and thematic sanctions regimes under the Sanctions and Anti-Money Laundering Act (2018). Retained EU law will maintain the remainder as the Government continues to lay SIs; all sanctions regimes will be under domestic legislation by the end of the year. Earlier this year my officials progressed a Statutory Instrument through Parliament which ensures that the UK\u2019s existing regulatory regime for ship and port security will continue to function effectively after EU Exit.<\/p>

The Statutory Instrument will enter into force on the day on which the UK leaves the EU. This Statutory Instrument includes provisions which enable the Government to continue to issue pre-arrival notification (PAN) exemptions to operators of vessels travelling on scheduled services from the EU into the UK after our withdrawal from the EU, even in a no deal scenario.<\/p>

Vessels travelling from the UK into the EU following the UK\u2019s withdrawal from the EU will need to provide the necessary pre-arrival security information for scheduled routes. The Government has taken forward the actions identified in the notice on seafarer certificates published in September 2018. We have introduced the Merchant Shipping (Standards of Training, Certification and Watchkeeping) (Amendment) (EU Exit) Regulations 2019. The regulations correct deficiencies in domestic legislation that would otherwise have existed as a result of the UK\u2019s withdrawal from the EU. This enables continued recognition of seafarer qualifications from EU and EEA countries.<\/p>

In the event the UK leaves the EU without a deal, there will be no practical changes to the UK\u2019s approach to immigration on journeys within the CTA. As now there will be no routine immigration controls on journeys from within the CTA to the UK; with no immigration controls whatsoever on the Northern Ireland \u2013 Ireland land border.<\/p>

If the UK leaves the EU without a deal the requirements for how professional qualifications will be recognised and services will be regulated will change. The guidance on providing services including those of a qualified professional<\/a> if there's no Brexit deal sets the future arrangements for how these areas will work in a \u2018no deal scenario\u2019.<\/p>

<\/p>

The Statutory Instruments referenced in this guidance have now been made:<\/p>

1) The Recognition of Professional Qualifications (Amendment etc.) (EU Exit) Regulations 2019.<\/p>

2) The Provision of Services (Amendment etc.) (EU Exit) Regulations 2018.<\/p>

<\/p>

This, along with other sector-specific legislation, means that recognition decisions awarded to EEA and Swiss professionals before exit day will be protected, and a new system for recognition of professional qualifications will come into force on exit day in a no deal scenario, giving certainty to professionals, business and public services.<\/p>

The Government has done the necessary work to make sure that we continue to have a stable and functioning financial services regime at the point of leaving the EU in a no deal scenario.<\/p>

<\/p>

The Government has delivered a programme of legislation under the EU Withdrawal Act in order to provide continuity for UK citizens and businesses and to ensure the UK regulatory regime can function effectively outside of the EU.<\/p>

<\/p>

This legislation includes temporary permissions for EEA firms currently passporting into the EU, and temporary permissions to allow UK firms to continue using Central Counterparties (CCPs) and Central Securities Depositories (CSDs) in the EEA. It also includes a transitional power for regulators to phase in post-exit regulatory requirements for firms where they have changed as a result of the UK leaving the EU.<\/p>

<\/p>

Following the six-month Article 50 extension, new EU financial services legislation will become applicable between now and 31 October 2019 and will therefore form part of UK law on exit day. We are laying further Statutory Instruments under the EU Withdrawal Act to ensure this new legislation is workable in the UK at exit.<\/p>

<\/p>

However, it should be noted that the UK authorities are not able through unilateral action to fully address all the risks. For example, the risks to EEA customers of UK firms currently providing services into the EEA using the financial services passport also require action from the EU or individual member states.<\/p>

<\/p>

We therefore welcome the steps taken by the EU and some individual member states to mitigate some of the risks. This includes: the EU\u2019s temporary equivalence and recognition for UK CCPs and CSDs; ESMA\u2019s decision to approve Memoranda of Understanding (MoUs) that include provisions to allow cross-border delegation of portfolio management between the UK and the EEA; and EIOPA recommendations which call on relevant member state regulators to put in place measures which aim to minimise detriment to insurance policyholders.<\/p>

<\/p>

As a responsible government, the Government has been preparing plans to minimise any disruption in the event of no deal for nearly three years.<\/p>
