The Government values the strong collaborative partnerships that we have across the European Union in the areas of science, research and innovation, and as part of exit negotiations is working to ensure that we have the best possible environment in which to support the United Kingdom medical research sector and patient access to cross-border clinical trials after we leave the EU.<\/p>

In the United Kingdom, the Medicines and Healthcare products Regulatory Agency, Health Research Authority, ethics services, National Institute for Health Research and the National Health Service have been working towards implementation of the new European Clinical Trials Regulation (CTR) since it was agreed in 2014. The application date of the CTR across the EU is yet to be set by the European Commission, but is expected to be in 2019.<\/p>

Whatever the outcome of the UK\u2019s EU exit negotiations, the current regulatory approval legislation will stay in place until such time as any changes are needed, so there will be no interruption in UK clinical trials approval. Clause 3 of the EU (Withdrawal) Bill will convert direct EU legislation, including EU regulations, into domestic law so far as they are \u201coperative\u201d in the UK immediately before exit day. EU regulations which are in force before the UK\u2019s departure, but are stated to apply after exit day, will not be converted by clause 3.<\/p>

The government has announced its intention to negotiate an implementation period with the EU. The framework for this period would be the existing structure of EU rules and regulations. We will need to discuss with the EU the details of how the implementation period will work in practice during the next phase of negotiations. The implementation period will be given effect in domestic law through the Withdrawal Agreement & Implementation Bill.<\/p>

The National Fund was created in 1928 with an initial anonymous donation of £500,000 with the aim of eventually extinguishing the national debt. It has accumulated significant funds through further donations and income over the years, as set out in the attached <\/ins><\/strong>chart below<\/del>. It is currently estimated to be worth over £460 million.<\/p>

The terms of the deed of Trust for the National Fund are such that the Trustees are required to accumulate the net income and profits of the trust fund until the value of the fund along with its accumulated income, when added to the value of any other funds applicable for the same purpose, is sufficient to discharge the entirety of the National Debt. Given the terms of the trust, the money is currently \u2018locked\u2019 in the fund.<\/p>

The Attorney General\u2019s Office is working with the Charity Commission and the Fund\u2019s trustees to help resolve this legally complicated matter.<\/p>

The European Union (Withdrawal) Bill aims to maximise certainty for individuals and businesses about their legal rights and obligations as we leave the EU in order to provide the basis for a smooth and orderly exit. The Bill will ensure that the laws and rules that we have now will, so far as possible, continue to apply.<\/p>

<\/strong><\/p>

The Bill will convert directly applicable EU law into domestic law. It will also preserve laws we have made in the UK to implement our EU obligations.<\/p>

<\/strong><\/p>

In particular, the UK has a long history of protecting human rights, which is unaffected by our withdrawal from the EU, and a strong history of protecting consumer rights. This Government has also made a clear commitment to protect workers\u2019 rights, and ensure that they keep pace with the changing labour market.<\/p>

<\/strong><\/p>

In recent weeks we have published a memorandum setting out where the rights in every article of the Charter of Fundamental Rights will continue to be protected in domestic law after exit, and we have set out how we intends to use the powers under clause 7 of the Bill to make amendments to employment legislation.<\/p>

The UK has a long history of environmental protection which we will safeguard and improve as we leave the EU. We will then have the opportunity, over time to design a set of policies to drive environmental improvement with a powerful and permanent impact, tailored to the needs of our country.
