Where Official Error overpayments do occur in a very small number of cases, the introduction of the 2012 Welfare Reform Act means that all overpayments of Universal Credit are recoverable.

Where recovery is made by deduction from Universal Credit, there is a limit placed on the overall amount that can be deducted which is currently 25% of the Standard Allowance. Moreover, a priority order is applied, which determines the order in which deductions can be made, with ‘last resort’ deductions, such as rent or fuel costs, taking precedence.

Anyone with overpayment deductions who does experience financial hardship is encouraged to contact the Department’s Debt Management unit. Where a person cannot afford the proposed rate, a lower amount can be negotiated.
"} , "answeringMember" : {"_about" : "http://data.parliament.uk/members/4033", "label" : {"_value" : "Biography information for David Rutley"} } , "answeringMemberConstituency" : {"_value" : "Macclesfield"} , "answeringMemberPrinted" : {"_value" : "David Rutley"} , "dateOfAnswer" : {"_value" : "2022-02-28", "_datatype" : "dateTime"} , "isMinisterialCorrection" : {"_value" : "false", "_datatype" : "boolean"} , "questionFirstAnswered" : [{"_value" : "2022-02-28T16:03:29.35Z", "_datatype" : "dateTime"} ]} , "answeringDeptId" : {"_value" : "29"} , "answeringDeptShortName" : {"_value" : "Work and Pensions"} , "answeringDeptSortName" : {"_value" : "Work and Pensions"} , "date" : {"_value" : "2022-02-22", "_datatype" : "dateTime"} , "hansardHeading" : {"_value" : "Universal Credit: Overpayments"} , "houseId" : {"_value" : "1"} , "legislature" : [{"_about" : "http://data.parliament.uk/terms/25259", "prefLabel" : {"_value" : "House of Commons"} } ], "questionText" : "To ask the Secretary of State for Work and Pensions, what her Department's policy is on resolving universal credit overpayments in the event that the overpayment is due to an error by her Department.", "registeredInterest" : {"_value" : "false", "_datatype" : "boolean"} , "tablingMember" : {"_about" : "http://data.parliament.uk/members/4751", "label" : {"_value" : "Biography information for Chris Loder"} } , "tablingMemberConstituency" : {"_value" : "West Dorset"} , "tablingMemberPrinted" : [{"_value" : "Chris Loder"} ], "uin" : "127540"} , {"_about" : "http://data.parliament.uk/resources/1420713", "AnsweringBody" : [{"_value" : "Department for Environment, Food and Rural Affairs"} ], "answer" : {"_about" : "http://data.parliament.uk/resources/1420713/answer", "answerText" : {"_value" : "

The Levelling Up the United Kingdom White Paper upholds the Government’s central mission to reverse the geographical inequalities faced by our communities by spreading opportunity more equally across the country and by bringing left behind communities up to the level of more prosperous areas. This means spreading prosperity to all corners of the UK, including West Dorset.

Firstly, Dorset County Council area is included as one of 55 areas identified by the Department for Education as new Education Investment Areas. More broadly, higher educational attainment will be supported by a £560 million investment over three years into a new National Youth Guarantee.

Second, an additional £1.6 billion has been allocated to the British Business Bank’s Regional Investment Funds, which provide debt and equity finance to SMEs. These funds will be specifically directed toward the South West and North East of England, providing significant opportunity for the 97% of businesses within West Devon that are either small or micro-sized.

Third, Dorset will also see 5 of the 11 new hospital schemes in the South West.

Finally, all areas of the UK will receive an allocation from the UK Shared Prosperity Fund via a funding formula rather than a competition. The fund will seek to restore pride in place to communities across the UK, and a new prospectus will be published later in Spring 2022.
"} , "answeringMember" : {"_about" : "http://data.parliament.uk/members/4679", "label" : {"_value" : "Biography information for Neil O'Brien"} } , "answeringMemberConstituency" : {"_value" : "Harborough"} , "answeringMemberPrinted" : {"_value" : "Neil O'Brien"} , "dateOfAnswer" : {"_value" : "2022-02-10", "_datatype" : "dateTime"} , "isMinisterialCorrection" : {"_value" : "false", "_datatype" : "boolean"} , "questionFirstAnswered" : [{"_value" : "2022-02-10T17:15:06.473Z", "_datatype" : "dateTime"} ]} , "answeringDeptId" : {"_value" : "211"} , "answeringDeptShortName" : {"_value" : "Levelling Up, Housing and Communities"} , "answeringDeptSortName" : {"_value" : "Levelling Up, Housing and Communities"} , "date" : {"_value" : "2022-02-03", "_datatype" : "dateTime"} , "hansardHeading" : {"_value" : "Regional Planning and Development: Dorset"} , "houseId" : {"_value" : "1"} , "legislature" : [{"_about" : "http://data.parliament.uk/terms/25259", "prefLabel" : {"_value" : "House of Commons"} } ], "questionText" : "To ask the Secretary of State for Levelling Up, Housing and Communities, what measures announced in his Department's Levelling Up the United Kingdom White Paper will specifically benefit West Dorset.", "registeredInterest" : {"_value" : "false", "_datatype" : "boolean"} , "tablingMember" : {"_about" : "http://data.parliament.uk/members/4751", "label" : {"_value" : "Biography information for Chris Loder"} } , "tablingMemberConstituency" : {"_value" : "West Dorset"} , "tablingMemberPrinted" : [{"_value" : "Chris Loder"} ], "uin" : "117898"} ], "itemsPerPage" : 10, "page" : 0, "startIndex" : 1, "totalResults" : 3, "type" : ["http://purl.org/linked-data/api/vocab#ListEndpoint", "http://purl.org/linked-data/api/vocab#Page"]} }
