The government recognises the difficulty and challenges facing those who have lost money because their funeral plan providers have been shown to be unable to fulfil the promises they made to their customers.

In January 2021, the government legislated to bring all pre-paid funeral plan providers and intermediaries within the regulatory remit of the Financial Conduct Authority (FCA) from 29 July 2022. This has ensured that 1.6 million funeral plan customers are, for the first time, protected by compulsory and robust regulation.

The two largest providers that have gone into administration since the government legislated are Safe Hands, with approximately 46,000 customers and One Life, with approximately 14,000 customers. We also understand that some smaller providers have entered administration.

During a wide-ranging meeting with industry in July 2017 to discuss pre-paid funeral plans, some concerns about Safe Hands funeral plans were raised with HM Treasury.

In response, officials advised that such concerns should be reported to the FCA, reflecting the fact that HM Treasury has no investigatory or enforcement powers of its own.
"} , "answeringMember" : {"_about" : "http://data.parliament.uk/members/4580", "label" : {"_value" : "Biography information for Baroness Vere of Norbiton"} } , "answeringMemberPrinted" : {"_value" : "Baroness Vere of Norbiton"} , "dateOfAnswer" : {"_value" : "2023-11-21", "_datatype" : "dateTime"} , "groupedQuestionUIN" : {"_value" : "HL35"} , "isMinisterialCorrection" : {"_value" : "false", "_datatype" : "boolean"} , "questionFirstAnswered" : [{"_value" : "2023-11-21T12:10:33.007Z", "_datatype" : "dateTime"} ]} , "answeringDeptId" : {"_value" : "14"} , "answeringDeptShortName" : {"_value" : "Treasury"} , "answeringDeptSortName" : {"_value" : "Treasury"} , "date" : {"_value" : "2023-11-07", "_datatype" : "dateTime"} , "hansardHeading" : {"_value" : "Funerals: Pre-Payment"} , "houseId" : {"_value" : "2"} , "legislature" : [{"_about" : "http://data.parliament.uk/terms/25277", "prefLabel" : {"_value" : "House of Lords"} } ], "questionText" : "To ask His Majesty's Government what is their estimate of the number of pre-paid funeral plan customers who lost the money they had invested prior to the sector becoming fully regulated by the Financial Conduct Authority in July 2022.", "registeredInterest" : {"_value" : "false", "_datatype" : "boolean"} , "tablingMember" : {"_about" : "http://data.parliament.uk/members/4159", "label" : {"_value" : "Biography information for Baroness Hayter of Kentish Town"} } , "tablingMemberPrinted" : [{"_value" : "Baroness Hayter of Kentish Town"} ], "uin" : "HL34"} , {"_about" : "http://data.parliament.uk/resources/1461073", "AnsweringBody" : [{"_value" : "Department for Business, Energy and Industrial Strategy"} ], "answer" : {"_about" : "http://data.parliament.uk/resources/1461073/answer", "answerText" : {"_value" : "

From the start of the pandemic, the higher education (HE) sector has put in significant resources and worked hard to provide learning materials and minimise the disruption to students. There have been some innovative and resourceful approaches to deliver high-quality learning online, and we welcome the huge amount of time and resources universities and other HE providers have devoted to ensuring that online teaching is of the high quality expected by students, Her Majesty's Government, and the Office for Students (OfS). Since early January, we estimate that 19% of students were on courses in scope for a return to face-to-face learning, and from 8 March 2021 this proportion increased to 49%. From 17 May 2021, all students have been able to return to in-person learning.

As autonomous institutions with a range of specific circumstances, we expect HE providers to make their own judgments to facilitate the return of students for face-to-face teaching, whilst following the latest public health guidance. We expect providers to continue work alongside local authorities and other agencies to put appropriate plans in place to control and manage any local outbreaks and to minimise transmission of COVID-19.

If students have concerns about their tuition, including the return to in-person teaching, there is a process in place. They should first raise their concerns with their university. If their concerns remain unresolved, students at providers in England or Wales can ask the Office of the Independent Adjudicator for Higher Education to consider their complaint. We expect providers to ensure that continuing and prospective students receive the clear, accurate, and timely information they need to make informed decisions. Whilst the OfS does not get involved in student complaints, students can notify it of issues which may be of regulatory interest to it. The OfS uses this information as part of its regulatory monitoring activity and keeps HE providers under review to ensure that they comply with the ongoing conditions of registration. The OfS has produced a guide for students to support them in this process. The Government has no plans to amend the UK’s Data Protection Act 2018 (DPA) to replicate those provisions contained in the Republic of India’s Personal Data Protection Bill.

The Government takes the protection of personal data and the right to privacy seriously. The DPA sets standards for protecting personal data in accordance with the General Data Protection Regulation (GDPR), and ensures that our laws are fit for the digital age in which an ever increasing amount of data is being processed.

The DPA has various exemptions that disapply a number of obligations on data controllers in certain circumstances, for example, the information required to be disclosed in connection with legal proceedings, crime and taxation. These exemptions do not oblige an organisation to disclose personal information.

All data controllers, including public authorities, are required to comply with the DPA. Organisations that collect and use personal data must do so with an appropriate legal basis and apply exemptions to the rules on a case by case basis.

Our focus is on getting the best deal possible for our farming industry and on providing stability for farmers as we leave the EU.

The UK’s World Trade Organisation (WTO) commitments are currently set out within the EU’s schedules.
