The Home Office does not hold data on the number of incidents of stalking reported to the police or on the number of people arrested for stalking. The Home Office holds data on the number of offences of stalking recorded by the police since April 2014 when stalking became a separately recorded classification (previously, stalking offences were included within harassment). The police recorded 1,682 stalking offences in the six month period April to September 2014. They are published in the quarterly Office for National Statistics publication of \u2018Crime in England and Wales\u2019.

The Protection of Freedoms Act 2012 created two new offences of stalking by inserting new sections 2A and 4A into the Protection from Harassment Act 1997. The new offences, which are not retrospective, came into force on the 25th<\/sup> of November 2012 and provide further options for prosecutors to consider when selecting charges. Between the introduction of the new stalking offences on the 25th<\/sup> of November 2012 and the end of September 2014, Crown Prosecution Service (CPS) data for stalking offences charged by prosecutors shows a steady rise. It is not possible to determine with certainty the impact that the stalking offences have had on the number of other offences charged under the Protection from Harassment Act 1997.<\/p>

1. <\/em>Whilst there is no strict legal definition of 'stalking', section 2A (3) of the <\/em> Protection from Harassment Act<\/em> 1997 sets out examples of acts or omissions which, in particular circumstances, are ones associated with stalking. These include: following, contacting, or attempting to contact a person by any means (this may be through friends, work colleagues, family or technology); or, other intrusions into the victim's privacy such as loitering in a particular place or watching or spying on a person. The effect of such<\/em> behaviour<\/em> is to curtail a victim's freedom, leaving them feeling that they constantly have to be watchful. In many cases, the conduct might appear innocent (if it were to be taken in isolation), but when carried out repeatedly so as to amount to a course of conduct, it may then cause significant alarm, harassment or distress to the victim.<\/em><\/p>

The Home Office does not hold this information centrally. The Home Office has received data on the number of stalking offences recorded in England and Wales since April 2014 as a separate offence category but these data do not contain
information on the sex of the victim or the perpetrator. Prior to April 2014, stalking offences under Protection of Freedoms Act 2012 were included within the harassment offence classification.

The latest available statistics show that between April and June 2014 there were 695 stalking offences recorded by the police in England and Wales.

The Ministry of Justice hold separate data for the number of cautions that have been issued for stalking. Between the implementation of the Protection of Freedoms Act in January 2013 and 30 June 2014 there were 57 cautions given for
stalking. This comprised of 49 given to males, 7 given to females and 1 where the gender was not stated.

Neither the Home Office nor the Ministry of Justice hold information on the number of individuals charged.<\/p>

The law is clear that what is illegal off-line is also illegal on-line and we have robust legislation in place to deal with internet trolls, cyber stalking
and harassment. The government brought in new stalking laws in November 2012 which sends a clear message that those responsible for stalking should be brought to justice. This will also help stop people living in fear and prevent escalation to more serious violence. From April 2013 to March 2014, 743 prosecutions were commenced under the new stalking legislation. This is a significant increase from the 67 prosecutions that were commenced from November 2012 to March 2013 and shows that the legislation is taking effect.

The government continues to work in collaboration with the College of Policing, the National Policing Lead on Stalking, and the Crown Prosecution Service, amongst others, to further raise awareness of the legislation and promote training to ensure these offences are tackled effectively. In July 2013 the Crown Prosecution Service published guidelines for prosecutors on the approach they should take in cases involving communications sent via social media. The College of Policing also wrote to all Chief Officers in July 2013 with advice on tackling online abuse.<\/p>

The Crown Prosecution Service (CPS) has developed two online e-Learning courses on all types of stalking. The \u201cCyber Crime: Cyber Stalking\u201d course includes cyber stalking, non-cyber stalking and harassment. The \u201cStalking and Harassment\u201d course (which was released in April 2014) deals specifically with stalking and harassment offences.<\/p>

The CPS maintains a central record of the number of employees who have been trained on the law on stalking by way of the e-Learning courses. 1581 of its employees in post on 23 October 2014 have completed all elements of either of the e-Learning courses in the period between 1 November 2012 (the month when the Cyber Stalking e-Learning module was revised to include the new stalking offences) and 23 October 2014.<\/p>

In October 2014 the CPS issued follow-up, face-to-face training material on the Stalking and Harassment offences. It can be used flexibly at a local CPS level; accordingly, its delivery is not recorded on a central database.<\/p>

The College of Policing sets standards and provides relevant training products and services to police forces. This includes a College of Policing training package on stalking, which was completed 56,748 times between October 2012 and 30 September 2014 by police officers and staff in England and Wales, and continues to be available.

Neither the College of Policing nor the Home Office holds information which breaks this figure down by the number of police officers and staff in England and Wales that have completed the training.

We are also working with the police and Crown Prosecution Service to raise awareness and improve professional knowledge.

To ensure prosecutors\u2019 knowledge is continuously refreshed, in April 2014, the CPS launched a specific e-learning module on stalking which focused on victim support, working with the police and ensuring a strong case is built from the start. The College of Policing is also undertaking a review of how stalking incidents are investigated by the police. This will include how the police understand what constitutes a course of conduct in policing, how the police support victims, and further training on the appropriate use of Police Information Notices.

Since April 2014, offences of stalking and harassment are being reported separately in Police Recorded Crime figures. This will allow us to monitor the impact of the legislation more effectively.

Convicted stalkers will already be captured on the Police National Computer. We are working to make better use of existing databases and improve connectivity and information sharing rather than creating new databases or registers for each and every offence.<\/p>

The Home Office collects data on the number of crimes recorded by the police but not how many complaints the police receive.

Prior to 1 April 2014, offences relating to stalking recorded by the police were included in the offence classification of harassment and cannot be
identified separately. From the 1 April 2014 these offences have been supplied to the Home Office as a separate classification of stalking. Therefore data are only available for the months April to June 2014, when the police recorded 695 offences. They are published in the quarterly Office for National Statistics publication of \u2018Crime in England and Wales\u2019.
