It includes guidance published by the Education and Skills Funding Agency (ESFA) for a variety of audiences. The ESFA communicates all major guidance updates through ESFA Update, which is issued to providers weekly, and ESFA inform, which is issued monthly. It has issued 49 editions of ESFA Update in 2021, 49 in 2020 and 50 in 2019. It has issued 9 editions of ESFA Inform in 2021, 8 in 2020 and 10 in 2019.<\/p>

The ESFA also publishes Business Update, which is aimed at FE providers and employers offering apprenticeships, highlighting related news and guidance updates. Sixth form colleges which become 16-19 academies will be able to enter into funding agreements with the Skills Funding Agency (SFA), providing that they are enabled to do so at the time when the college becomes an academy. Detailed guidance on the criteria and application process for area reviews will be published in February 2016. All sixth form colleges in England will have the opportunity to apply as part of the relevant area review. Their applications will be considered alongside other recommendations from the review in their area.<\/p>

The Joint Area Review Delivery Unit will work with the sixth form colleges included in the first wave of reviews, which is currently under way, to ensure that they have the opportunity to develop information to support an application and to prepare applications in advance of the publication of detailed criteria in February.<\/p>

Three sixth form colleges were included in two pilot post-16 area reviews earlier this year. These reviews have now concluded and their recommendations are being implemented. The Education Funding Agency (EFA) regularly assesses the financial viability of sixth-form colleges on behalf of the department. Those assessments take account of all income and costs for colleges, including costs relating to VAT and pension liabilities.<\/p>

The department estimates that VAT accounts for about 3% of sixth form colleges\u2019 expenditure each year.<\/p>

With regards to pension costs, sixth-form colleges may contribute to a number of pension schemes. The SFC financial returns are available online at https://www.gov.uk/government/publications/sfa-financial-management-college-accounts<\/a> and show employer contributions to pensions. The EFA does not routinely collect data on the cost of other pension schemes through financial returns.<\/p>

Decisions about how 16-19 institutions will be funded in 2016/17 will be subject to the outcome of the next cross-government spending round.<\/p>

Current capital allocations paid to sixth form colleges are in many cases already funded at 100% of the total project cost including VAT, where it is payable. This means that although colleges have to pay VAT on some building works they are not necessarily disadvantaged because of the VAT rules on Education Funding Agency funded programmes. However, we acknowledge that they are not able to recover their VAT costs on self-funded capital projects and certain areas of non-capital expenditure.<\/p>

VAT refund schemes are the responsibility of Her Majesty\u2019s Treasury. The Department for Education continues to look at how the capital needs of sixth form colleges can be met.<\/p>

It would be legally possible for a sixth form college to become an academy, but the Department is not currently able to consider applications. Ministers have had numerous discussions with sixth form colleges about VAT exemption since May 2010.<\/p>
