The NHS Constitution allows patients to be treated by any provider who holds a contract for the provision of National Health Services. This is a legal right, although there are certain circumstances in which a choice may not be possible. Further information is available at the following link:

Last year, the Government set out how it will make it easier for patients to exercise their choice by improving the NHS App, increasing choice for patients already on waiting lists, and raising awareness of patients’ right to choose.

At the point of referral, for example at a general practice appointment, patients will be actively offered a list of providers which are clinically appropriate for their condition. This will be a minimum of five providers where possible. Patients will also be informed of their right to choose, and encouraged to raise this at the time of the referral.
"} , "answeringMember" : {"_about" : "http://data.parliament.uk/members/4044", "label" : {"_value" : "Biography information for Andrew Stephenson"} } , "answeringMemberConstituency" : {"_value" : "Pendle"} , "answeringMemberPrinted" : {"_value" : "Andrew Stephenson"} , "dateOfAnswer" : {"_value" : "2024-05-08", "_datatype" : "dateTime"} , "isMinisterialCorrection" : {"_value" : "false", "_datatype" : "boolean"} , "questionFirstAnswered" : [{"_value" : "2024-05-08T15:47:36.187Z", "_datatype" : "dateTime"} ]} , "answeringDeptId" : {"_value" : "17"} , "answeringDeptShortName" : {"_value" : "Health and Social Care"} , "answeringDeptSortName" : {"_value" : "Health and Social Care"} , "date" : {"_value" : "2024-05-02", "_datatype" : "dateTime"} , "hansardHeading" : {"_value" : "Patient Choice Schemes"} , "houseId" : {"_value" : "1"} , "legislature" : [{"_about" : "http://data.parliament.uk/terms/25259", "prefLabel" : {"_value" : "House of Commons"} } ], "questionText" : "To ask the Secretary of State for Health and Social Care, pursuant to the Answer of 8 February 2024 to Question 12829 on Patient Choice Schemes, how many patients were offered choice at the point of referral in each of the last 12 months.", "registeredInterest" : {"_value" : "false", "_datatype" : "boolean"} , "tablingMember" : {"_about" : "http://data.parliament.uk/members/4504", "label" : {"_value" : "Biography information for Wes Streeting"} } , "tablingMemberConstituency" : {"_value" : "Ilford North"} , "tablingMemberPrinted" : [{"_value" : "Wes Streeting"} ], "uin" : "24684"} , {"_about" : "http://data.parliament.uk/resources/1687019", "AnsweringBody" : [{"_value" : "Department of Health and Social Care"} ], "answer" : {"_about" : "http://data.parliament.uk/resources/1687019/answer", "answerText" : {"_value" : "

This will be a minimum of five providers where possible. Patients will also be informed of their right to choose and encouraged to raise this at the time of the referral.

Since the commitments made by the Government in May 2023, we have seen an increase in the number of patients being offered choice at the point of referral. The Department does not hold data regarding patients choosing between a hospital and clinic for their first outpatient appointment each month. The Department has also not made an estimate of how many patients were aware, before visiting their GP, of their right to choose the provider for their first outpatient appointment.

In autumn last year, the Department ran a press partnership campaign to raise awareness and increase understanding of choice. Furthermore, the Department has recently launched a marketing campaign, aimed at all adults, to increase awareness of a patient's right to choose where they receive their hospital care, as well as encourage more people to actively make a choice.
"} , "answeringMember" : {"_about" : "http://data.parliament.uk/members/4044", "label" : {"_value" : "Biography information for Andrew Stephenson"} } , "answeringMemberConstituency" : {"_value" : "Pendle"} , "answeringMemberPrinted" : {"_value" : "Andrew Stephenson"} , "dateOfAnswer" : {"_value" : "2024-02-08", "_datatype" : "dateTime"} , "groupedQuestionUIN" : [{"_value" : "12827"} , {"_value" : "12828"} , {"_value" : "12830"} ], "isMinisterialCorrection" : {"_value" : "false", "_datatype" : "boolean"} , "questionFirstAnswered" : [{"_value" : "2024-02-08T10:03:40.147Z", "_datatype" : "dateTime"} ]} , "answeringDeptId" : {"_value" : "17"} , "answeringDeptShortName" : {"_value" : "Health and Social Care"} , "answeringDeptSortName" : {"_value" : "Health and Social Care"} , "date" : {"_value" : "2024-02-02", "_datatype" : "dateTime"} , "hansardHeading" : {"_value" : "Patient Choice Schemes"} , "houseId" : {"_value" : "1"} , "legislature" : [{"_about" : "http://data.parliament.uk/terms/25259", "prefLabel" : {"_value" : "House of Commons"} } ], "questionText" : "To ask the Secretary of State for Health and Social Care, what estimate she has made of how many patients are being offered a choice between hospital and clinic for their first outpatient appointment each month.", "registeredInterest" : {"_value" : "false", "_datatype" : "boolean"} , "tablingMember" : {"_about" : "http://data.parliament.uk/members/4504", "label" : {"_value" : "Biography information for Wes Streeting"} } , "tablingMemberConstituency" : {"_value" : "Ilford North"} , "tablingMemberPrinted" : [{"_value" : "Wes Streeting"} ], "uin" : "12829"} , {"_about" : "http://data.parliament.uk/resources/1687020", "AnsweringBody" : [{"_value" : "Department of Health and Social Care"} ], "answer" : {"_about" : "http://data.parliament.uk/resources/1687020/answer", "answerText" : {"_value" : "
