The Public Services (Social Value) Act 2012 places a requirement on commissioners, including local authorities, to consider the social, economic and environmental benefits of their approaches to services contracts before the procurement process starts. The existing scheme of UK procurement rules, which implement the EU public procurement directives, are preserved under the European Union (Withdrawal) Act 2018 when the UK leaves the European Union, with relevant adjustments necessary to ensure legal operability. Local authorities contemplating the use of their compulsory purchase powers to acquire land and properties should consider, amongst other things, whether there is a compelling case in the public interest for doing so. They should also take account of government's guidance on the compulsory purchase process, which was published in October 2015.<\/p>

The Local Government Act 1999 (Part 1, Section 3) requires an authority to carry out the functions designated to it in accordance with the \u2018best value duty\u2019. This requires that "A best value authority must make arrangements to secure continuous improvement in the way in which its functions are exercised, having regard to a combination of economy, efficiency and effectiveness\u201d. The duty applies to the full range of an authority\u2019s activities.<\/p>

Local authorities have the freedom to borrow and invest, including in land and property purchases, without government consent, provided that their borrowing is affordable. Control is exercised through four statutory codes that local authorities are required to have regard to, two prepared by the Chartered Institute of Public Finance and Accountancy (CIPFA) and two prepared by DCLG. This framework is known as the \u201cPrudential System\u201d. We are currently working with CIPFA to revise the statutory codes and guidance and the intention is for these to be in place early in 2018.<\/p>

The Government is committed to ensuring there is a simple and consistent approach to procurement across the public sector so that small businesses can gain better and more access to public sector contracts \u2013 either directly or as sub-contractors.<\/p>

The Government produced guidance as part of the reforms included in the Public Contract Regulations 2015 which aim to make public contracts more accessible to businesses and in particular to small and medium enterprises. The reforms included the abolition of pre-qualification questionnaire for low value tenders; simplification of the pre-qualification questionnaire for high value tenders; advertising all local authority contracts of £25,000 or over (or the authority\u2019s standing order limit if higher) on Contracts Finder; and paying down the supplier chain in 30 days.<\/p>

The Local Government Transparency Code 2015 requires all local authorities to publish details of contracts exceeding £5,000 including information on whether or not the supplier is a small or medium sized enterprise and/or a voluntary or community sector organisation.<\/p>
