The Government has been clear that more must be done to accelerate the pace of remediation of unsafe buildings across the country.<\/p>

After the Grenfell Tower tragedy, the Government prioritised identifying and providing funding for the highest risk buildings with unsafe cladding. Fire and rescue services and local authorities conducted a risk review of high-rise buildings over 18 metres in height, and building owners were required to register high-rise buildings with the department and apply for government funding to remove dangerous cladding.<\/p>

The Building Safety Act 2022 establishes a new regulatory regime for high-rise buildings, which requires all residential buildings above 18 metres or seven storeys to be registered with the Building Safety Regulator by October 2023. The regulator has powers to pursue any building owner who fails to comply, including prosecuting for non-compliance.<\/p>

In 2022, the Cladding Safety Scheme (CSS) was launched, to meet the cost of addressing life safety fire risks associated with cladding in buildings over 11 metres. Eligible building owners can apply for this scheme, and leaseholders can utilise the \u2018Tell us tool\u2019 to self-refer their building: Tell us about life-safety fire risks on the external wall system of your building - GOV.UK (www.gov.uk)<\/a>.<\/p>

The department is working at pace to identify buildings eligible for funding that are not coming forward. We are utilising specialist data sources and knowledge from local regulators to identify buildings eligible for funding.<\/p>

The Deputy Prime Minister wrote to mayoral authorities on the 13 September to support and empower them to deliver plans, which use their convening powers, relationships and local knowledge to accelerate where buildings are not remediating quickly. The identification of buildings with unsafe cladding falls within the remit of this initiative. The department collects data on the number of residential buildings over 18 metres in height in England with unsafe aluminium composite material (ACM) cladding. In the Gateshead Central and Whickham constituency, fewer than 10 such buildings have been identified, but the exact number cannot be disclosed to protect the privacy of individual buildings.<\/p>

Leaseholders in buildings over 11 metres or five storeys are protected from paying for remediation of safety defects if the developer has signed the developer remediation contract. Additionally, the Government has made £5.1 billion available through the Building Safety Fund and Cladding Safety Scheme to cover cladding repairs for buildings over 18 metres where no responsible developer can be identified.<\/p>

Furthermore, Remediation Contribution Orders provide leaseholders with a means to recover historical safety remediation costs from those responsible, such as developers.<\/p>

The Leasehold Advisory Service (LEASE), funded by the department, offers free legal advice to leaseholders.<\/p>

The Government is committed to protecting qualifying leaseholders from the costs of fixing historic building safety defects that were not their fault.\u202f Legislation has been introduced to ensure that qualifying leaseholders are both protected from costs and can pursue building owners and developers for contributions to fix these issues.\u202fPathways are in place for all residential buildings over 11 meters in England to fix unsafe cladding through government funds, developer contributions, or registered providers of social housing.<\/p>

Too many buildings still have unsafe cladding, and the pace of remediation has been too slow. Any building owner who fails to make their building safe faces enforcement action. The Code of Practice for the Remediation of Residential Buildings requires all remediation projects to treat residents as key stakeholder in the remediation process.<\/p>

The Government does not hold the data on the number of buildings where insulation has been installed through a government funded scheme and subsequently required remediation work.<\/p>

Since 2019, all installations under government energy efficiency schemes have been required to be carried out by TrustMark registered and PAS 2030 or MCS certified businesses to improve the quality of installations and protect consumers. It is generally accepted that the life safety risk is proportional to the height of buildings.\u202f\u202f\u202fThe risk\u202fto life\u202ffrom historical fire safety defects is lower in buildings under 11m, therefore\u202fbuilding safety related remediation works are required in a very small number of buildings under 11m.<\/p>

In rare cases where remediation work is required in buildings under 11 metres, the government has retrospectively extended the limitation period under Section 1 of the Defective Premises Act 1972 enabling legal action against developers and contractors where works completed in the last 30 years made a dwelling not \u201cfit for habitation\u201d.<\/p>
