The Academies Financial Handbook is not prescriptive about where academy trusts buy the services that they need. Trusts are free to choose, but in doing so they have important responsibilities. The regional schools commissioners (RSCs) have been involved in nine applications for new academies under the academy presumption (section 6A of the Education and Inspections Act 2006). RSCs do not make the decision about whether a new school is needed or not. This decision lies with the relevant local authority, and arises from the basic need for more pupil places. The RSCs\u2019 role is limited to deciding who would be the best proposer to establish the new school.<\/p>

In six cases the RSC approved the proposer recommended by the local authority. In three cases a different proposer was approved. In each case this decision was taken based on an assessment of the capacity, capability and performance of all proposers.<\/p>

Paragraph 1.5.21 of the handbook explains that the accounting officer of a trust must ensure that the trust\u2019s financial conduct is regular, proper and represents good value for money. In addition, paragraph 3.3.1 of the handbook explains that all novel and/or contentious transactions must be referred to the Education Funding Agency (EFA) for prior authorisation.<\/p>

In the case of a novel and/or contentious transaction, the EFA would always seek strong assurance from the trust that its proposal represented excellent value for money and that there was no risk of irregularity or impropriety.
