The Department does not consider that increasing fine levels would be a suitable way to reduce the numbers to drivers idling unnecessarily. We believe there are other effective ways of influencing driver behaviour and increasing public awareness of the damaging air quality impact of unnecessary idling. Unnecessary vehicle idling is already an offence under The Road Traffic (Vehicle Emissions) (Fixed Penalty) (England) Regulations 2002, with equivalent devolved powers. It is also the subject of rule 123 of the Highway Code, which drivers are required to learn and observe.<\/p>

Local Authorities, which are responsible for enforcement, are free to take other measures to discourage engine idling, including additional signage at specific locations. Local authorities already have the powers to issue fixed penalty notices of £20 to drivers who allow their vehicle engines to run unnecessarily while the vehicle is stationary, using powers under the Road Traffic (Vehicle Emissions) (Fixed Penalty) (England) Regulations 2002, and are able to use signage to discourage idling. Local authorities can also voluntarily introduce Clean Air Zones should they wish to do so using their powers under the Transport Act 2000. Clean Air Zones can be used to address vehicle idling.<\/p>
