In April 2020 the National Police Chiefs\u2019 Council (NPCC), Crown Prosecution Service, The Law Society, Criminal Law Solicitors\u2019 Association and London Criminal Courts Solicitors Association agreed a joint protocol to facilitate the provision of remote legal advice for suspects being interviewed under caution in police stations during the pandemic. As a contingency measure, the Legal Aid Agency (LAA) agreed temporarily to pay for remote police station work as if it were provided in person.<\/p>

From 17 May 2021 children under 18 and vulnerable adults were removed from the scope of the protocol and receive in-person advice.<\/p>

As a result of this the national fire safety team produced an action plan which set out measures to be taken to mitigate these risks. Action has been taken to prevent the spread of fire such as fire stopping works. To mitigate the impact of any potential fires all fire doors are regularly tested, and smoke detectors have been installed. The effectiveness of escape routes has also been confirmed and staff and prisoners are aware of appropriate actions in the event of a fire.<\/p>

In order to obtain a more thorough picture of the risks involved an invasive survey is due to be undertaken shortly to identify the composition of the walls. This will enable identification of what, if any, structural building work is required.<\/p>

Initially the contractor\u2019s supply chain had a limited number of suppliers, which resulted in cost estimates for work submitted being excessive and these were rejected by the MoJ team. The MoJ has instructed that the supply chain is broadened to include more SME companies to tender for these works. This determination to use SME companies has led to some delays but it means that there are much better procurement options that will provide more effective and value for money solutions.<\/p>

The local Service Delivery Manager will continue to challenge all costs which they feel are excessive and escalate them to the Regional Estates Manager, who has regular commercial and project meetings with the contractor\u2019s management. The Government\u2019s primary responsibility is to protect the public. Accredited programmes aim both to protect the public and to reduce re-offending: they are part of a range of rehabilitation and risk reduction opportunities available in prisons. In recent years, there has been a change in emphasis, away from shorter, moderate-intensity programmes, in favour of longer, higher-intensity programmes. H M Prison & Probation Service remains committed to supporting the progression of those serving indeterminate (IPP) and life sentences of imprisonment, so that the Parole Board may direct their release, or re-release, as soon as it is safe to do so.<\/p>

To aid recovery planning for offending behaviour programmes following the pandemic, we have put in place new data collection systems. These enable us to provide the requested information in relation to 2021, and this is set out in the table below. We do not hold information prior to that date.<\/p>

The information provided covers both offending behaviour and sexual offending programmes. Substance misuse programmes are the responsibility of NHS commissioners and we do not hold information in relation to them. The table shows the number of IPP prisoners waiting to commence an accredited general, violence, domestic violence, or sexual offending programme, based on information gathered from prisons which run accredited offending behaviour programmes, in data snapshots in January, April and August 2021. The information has been drawn from local records and, as with any large-scale reporting tool, may be subject to inaccuracies as well as subject to change.<\/p>

The data HMPPS hold on transgender prisoners (published in the annual HMPPS Offender Equalities Report) is snapshot data and importantly has not historically included prisoners who have a Gender Recognition Certificate, due to legal restrictions. There was no data gathering exercise in 2020 due to the pandemic. HMPPS are actively working on ways to improve the scope and quality of data held on transgender prisoners while still respecting their rights and privacy.<\/p>

Analysis of accredited programme participation for each year\u2019s transgender offender cohort requires a data matching exercise as these pieces of information are held in separate data sets. HMP Downview\u2019s E Wing currently provides separate accommodation in the women\u2019s estate specifically for transgender women with Gender Recognition Certificates (GRC) who pose, or face, too high a risk to be located in the general women\u2019s population. Decisions on allocation of this nature can only be made via a Complex Case Board, chaired by a senior prison manager, as detailed in \u2018The Care and Management of Individuals who are Transgender\u2019 policy framework<\/p>


It is not Ministry of Justice and HM Prison & Probation Service (HMPPS) policy to place women on E Wing who do not hold a GRC. In exceptional circumstances, such as those seen during the COVID-19 pandemic, it remains open to HMPPS to utilise accommodation differently where it is considered operationally necessary.
