The information requested is set out in the table below:

Current and comparative mean waiting times1 for Personal Independence Payment (PIP) appeals

October – December 182

31 weeks

October – December 17

25 weeks

1. Waiting time is interpreted as average clearance time - time taken from appeal receipt to outcome.

2. The latest period for which data are available

The volume of appeals against decisions on PIP has built up since it was introduced as a new benefit, incrementally over time, from 2013. As the number of appeals has increased, so has the average waiting time for an appeal outcome.

Waiting times are calculated from receipt of an appeal to its final disposal. An appeal is not necessarily disposed of at its first hearing. The final disposal decision on the appeal may be reached after an earlier hearing had been adjourned (which may be directed by the judge for a variety of reasons, such as to seek further evidence), or after an earlier hearing date had been postponed (again, for a variety of reasons, often at the request of the appellant). An appeal may also have been decided at an earlier date by the First-tier Tribunal, only for the case to have gone on to the Upper Tribunal, to be returned once again to the First-tier, for its final disposal.

Waiting times can fluctuate temporarily and geographically, owing to a number of variable factors, including volumes of benefit decisions made locally, availability of medical/disability members, venue capacity and the complexity of the issue in dispute. Any disparity in waiting times is monitored and investigated locally.
"} , "answeringMember" : {"_about" : "http://data.parliament.uk/members/4538", "label" : {"_value" : "Biography information for Lord Keen of Elie"} } , "answeringMemberPrinted" : {"_value" : "Lord Keen of Elie"} , "dateOfAnswer" : {"_value" : "2019-06-20", "_datatype" : "dateTime"} , "isMinisterialCorrection" : {"_value" : "false", "_datatype" : "boolean"} , "questionFirstAnswered" : [{"_value" : "2019-06-20T16:55:12.45Z", "_datatype" : "dateTime"} ]} , "answeringDeptId" : {"_value" : "54"} , "answeringDeptShortName" : {"_value" : "Justice"} , "answeringDeptSortName" : {"_value" : "Justice"} , "date" : {"_value" : "2019-06-05", "_datatype" : "dateTime"} , "hansardHeading" : {"_value" : "Personal Independence Payment: Appeals"} , "houseId" : {"_value" : "2"} , "legislature" : [{"_about" : "http://data.parliament.uk/terms/25277", "prefLabel" : {"_value" : "House of Lords"} } ], "questionText" : "To ask Her Majesty's Government what is the current mean waiting time for Personal Independence Payment appeals; how that differs from the mean waiting time for the previous year; and, if the mean waiting time has risen compared to the previous year, what are the reasons for that rise.", "registeredInterest" : {"_value" : "false", "_datatype" : "boolean"} , "tablingMember" : {"_about" : "http://data.parliament.uk/members/4333", "label" : {"_value" : "Biography information for Lord Scriven"} } , "tablingMemberPrinted" : [{"_value" : "Lord Scriven"} ], "uin" : "HL16119"} , {"_about" : "http://data.parliament.uk/resources/1129521", "AnsweringBody" : [{"_value" : "Ministry of Justice"} ], "answer" : {"_about" : "http://data.parliament.uk/resources/1129521/answer", "answerText" : {"_value" : "

Any foreign national who comes to our country and abuses our hospitality by breaking the law should be in no doubt of our determination to punish and deport them. More than 48,000 foreign national offenders have been removed from the UK since 2010, and in the last financial year more than 5,000 were removed from prisons, immigration removal centres, and the community.

Prisoner transfer is one of the mechanisms used to remove foreign national offenders. Between 1 May 2014 and 31 May 2019, 464 sentenced prisoners were transferred from England and Wales to other countries under international prisoner transfer arrangements. During the same period 233 sentenced prisoners were transferred to England and Wales.
