His Majesty\u2019s Government is committed to implementing protections for children from online pornography, including the provisions in Part 5 of the Online Safety Bill, as quickly as possible. The Government\u2019s intention is to have the online safety regime operational as soon as possible after Royal Assent, while ensuring the necessary preparations are completed effectively and service providers understand what is expected. We are working closely with Ofcom to ensure this.<\/p>

As set out in Ofcom\u2019s Roadmap to Regulation, an important consideration for the implementation of Part 5 will be the need to ensure a consistency in approach across all providers of online pornography, including those hosting user-generated content subject to the duties of Part 3. This is to ensure the legislation effectively protects children from pornography, wherever it appears online. Ofcom also needs appropriate time and flexibility properly to produce and then consult relevant statutory consultees on the relevant guidance, including those who represent the interests of children.<\/p>

Ofcom will be able to use its enforcement powers, including the power to issue a provisional notice of contravention relating to Part 5, once clause 68, which sets out the duties for regulated provider pornographic content, is commenced. We do not, however, expect to see sanctions applied, except in the most egregious cases, until Ofcom has worked with regulated entities to ensure they have sufficient knowledge and notice of the new regulatory framework. Before issuing any sanctions Ofcom will undertake a full and fair investigation of any suspected non-compliance.<\/p>

The introduction of the Bill should be taken as a clear message to companies that they need to begin preparing for regulation now.<\/p>

The Online Safety Bill will apply to companies which allow users to post content online or to interact with each other, as well as to search services.<\/p>

The Online Safety Bill will ensure that users in the UK are protected. It will apply to any relevant service which is \u2018linked to the UK\u2019, no matter where it is based. A service is linked to the UK if it has a significant number of UK users, UK users form a target market, or if it poses a material risk of significant harm to UK individuals.<\/p>

The onus will be on companies to ensure that their systems are sufficiently effective. The experience of Molly Russell and her family highlights the importance of holding tech companies to account to keep their users, and in particular children, safe online. The Government has consulted widely, including with parents and children, to develop the new regulatory framework.<\/p>

A set of statutory duties will be placed on Ofcom, requiring the regulator to conduct research and consult with users when carrying out their online safety duties. This includes the opinions and experiences of children, parents and families, which Ofcom will use when developing its codes of practice.<\/p>

The Bill will also require companies to enable children, and their parents or guardians, to easily report harmful content and, where necessary for those companies to take action.<\/p>

The Online Safety Bill includes measures to encourage regulated service providers to promote media literacy to their users. Following a recommendation from the Joint Committee which conducted the pre-legislative scrutiny of the Online Safety Bill, media literacy is now included in the risk assessment duties. This requires in-scope companies to consider how the promotion of users\u2019 media literacy can be used to mitigate harms on their platforms.<\/p>

Media literacy is also expressly referred to in Ofcom\u2019s new transparency reporting and information gathering powers, giving Ofcom enhanced visibility of industry spending and activity related to media literacy. Social media platforms currently play a significant role in boosting media literacy, in particular with regards to the funding of programmes. Priority harmful content to children and adults will be set out in secondary legislation once the Secretary of State has been granted the relevant powers to make regulations for priority harmful content under the Bill.<\/p>

Priority harmful content to children and adults will be set out in secondary legislation once the Secretary of State has been granted the relevant powers to make regulations for priority harmful content under the Bill.<\/p>
