Under the Working Time Regulations 1998, almost all workers are entitled to 5.6 weeks annual leave, which should be paid as if workers were still at work and working. Annual leave continues to accrue as long as the worker maintains their employment relationship with their employer, which is the case whilst an employee is on a period of furlough through the Coronavirus Job Retention Scheme.<\/p>

Regarding length of service, a furlough period is a variation to a worker\u2019s contract of employment. The contract of employment would continue and count towards continuous employment.<\/p>

The Government has been clear that employment rights remain unchanged under the Coronavirus Job Retention Scheme. The Government is supporting the self-employed through an unprecedented package of measures during this period of disruption. Measures include a temporary relaxation of the earnings rules (known as the Minimum Income Floor) for self-employed claimants who are sick or self-isolating according to Government guidance. The Government has extended this to all self-employed claimants, not just those directly impacted by the virus, ensuring those affected by the economic impact of the outbreak are supported.<\/p>

On 26 March, the Chancellor announced a world-leading scheme to support the UK\u2019s self-employed affected by Covid-19. The Self-employment Income Support Scheme (SEISS) will support self-employed individuals, including members of partnerships, whose income has been negatively impacted.
