Under the Road Traffic (Vehicle Emissions) (Fixed Penalty) (England) Regulations 2002, local authorities already have powers to enforce anti-idling laws and issue fixed penalty notices (FPNs) to drivers leaving engines running unnecessarily.

The enforcement powers available to tackle vehicle idling are available to all local authorities, regardless of whether or not they have an Air Quality Management Area (AQMA). It is vital that these powers are used to help deal with local air quality issues where necessary and there are no plans to review these powers.

Within AQMAs, designated local authorities also have powers to carry out roadside testing of vehicle emissions to reduce pollution from road traffic. They can do this where any part of the area is designated as an AQMA in accordance with the legislation. The local authority must apply to the Secretary of State for Transport to be a designated local authority.

Since these powers became available, vehicle technology has moved on significantly. Newer technologies can play a part in addressing idling emissions, such as stop-start technology and low- or -zero-emission vehicles.
"} , "answeringMember" : {"_about" : "http://data.parliament.uk/members/4522", "label" : {"_value" : "Biography information for Rebecca Pow"} } , "answeringMemberConstituency" : {"_value" : "Taunton Deane"} , "answeringMemberPrinted" : {"_value" : "Rebecca Pow"} , "dateOfAnswer" : {"_value" : "2021-07-15", "_datatype" : "dateTime"} , "isMinisterialCorrection" : {"_value" : "false", "_datatype" : "boolean"} , "questionFirstAnswered" : [{"_value" : "2021-07-15T15:51:10.81Z", "_datatype" : "dateTime"} ]} , "answeringDeptId" : {"_value" : "13"} , "answeringDeptShortName" : {"_value" : "Environment, Food and Rural Affairs"} , "answeringDeptSortName" : {"_value" : "Environment, Food and Rural Affairs"} , "date" : {"_value" : "2021-07-12", "_datatype" : "dateTime"} , "hansardHeading" : {"_value" : "Motor Vehicles: Exhaust Emissions"} , "houseId" : {"_value" : "1"} , "legislature" : [{"_about" : "http://data.parliament.uk/terms/25259", "prefLabel" : {"_value" : "House of Commons"} } ], "questionText" : "To ask the Secretary of State for Environment, Food and Rural Affairs, what enforcement measures are available to local authority officers to tackle vehicle idling in (a) Air Quality Management Areas and (b) non-Air Quality Management Areas; and whether the Government has plans to review those enforcement powers.", "registeredInterest" : {"_value" : "false", "_datatype" : "boolean"} , "tablingMember" : {"_about" : "http://data.parliament.uk/members/4813", "label" : {"_value" : "Biography information for Mr Richard Holden"} } , "tablingMemberConstituency" : {"_value" : "North West Durham"} , "tablingMemberPrinted" : [{"_value" : "Mr Richard Holden"} ], "uin" : "31563"} , {"_about" : "http://data.parliament.uk/resources/1280274", "AnsweringBody" : [{"_value" : "Department for Environment, Food and Rural Affairs"} ], "answer" : {"_about" : "http://data.parliament.uk/resources/1280274/answer", "answerText" : {"_value" : "

The 2017 UK Plan for Tackling Roadside Nitrogen Dioxide Concentrations outlines how local authorities with persistent NO2 exceedances, identified using national modelling, must take robust action to improve air quality. We are working closely with these local authorities and making £880m of funding available to deliver compliance with NO2 levels as soon as possible.

Local authorities are also required to review and assess local air quality. If their assessment shows that local pollution levels exceed local air quality objectives they must declare an Air Quality Management Area and develop an Air Quality Action Plan with the aim of reducing air pollution to within statutory limits.

Local authorities have a range of powers to take action to reduce pollution from road vehicles, such as restricting car access around schools and enforcing anti-idling laws. In addition, Defra’s Air Quality Grant programme provides funding to local authorities for projects in local communities to tackle air pollution. The Government has awarded over £64 million in funding since the air quality grant started in 1997.
"} , "answeringMember" : {"_about" : "http://data.parliament.uk/members/4522", "label" : {"_value" : "Biography information for Rebecca Pow"} } , "answeringMemberConstituency" : {"_value" : "Taunton Deane"} , "answeringMemberPrinted" : {"_value" : "Rebecca Pow"} , "dateOfAnswer" : {"_value" : "2021-02-02", "_datatype" : "dateTime"} , "isMinisterialCorrection" : {"_value" : "false", "_datatype" : "boolean"} , "questionFirstAnswered" : [{"_value" : "2021-02-02T17:28:11.7Z", "_datatype" : "dateTime"} ]} , "answeringDeptId" : {"_value" : "13"} , "answeringDeptShortName" : {"_value" : "Environment, Food and Rural Affairs"} , "answeringDeptSortName" : {"_value" : "Environment, Food and Rural Affairs"} , "date" : {"_value" : "2021-01-25", "_datatype" : "dateTime"} , "hansardHeading" : {"_value" : "Motor Vehicles: Exhaust Emissions"} , "houseId" : {"_value" : "1"} , "legislature" : [{"_about" : "http://data.parliament.uk/terms/25259", "prefLabel" : {"_value" : "House of Commons"} } ], "questionText" : "To ask the Secretary of State for Environment, Food and Rural Affairs, what steps he has taken to assess in which areas of the UK roadside air pollution is most prevalent and dangerous; and what steps he is taking with local authorities to tackle air pollution in those areas.", "registeredInterest" : {"_value" : "false", "_datatype" : "boolean"} , "tablingMember" : {"_about" : "http://data.parliament.uk/members/411", "label" : {"_value" : "Biography information for Mr Barry Sheerman"} } , "tablingMemberConstituency" : {"_value" : "Huddersfield"} , "tablingMemberPrinted" : [{"_value" : "Mr Barry Sheerman"} ], "uin" : "142781"} ], "itemsPerPage" : 10, "page" : 0, "startIndex" : 1, "totalResults" : 2, "type" : ["http://purl.org/linked-data/api/vocab#ListEndpoint", "http://purl.org/linked-data/api/vocab#Page"]} }
