The Police, Crime, Sentencing and Courts Act 2022, which received Royal Assent in April, strengthened the police\u2019s powers to arrest and seize the vehicles and other property of those who set up unauthorised encampments and cause damage, disruption or distress.<\/p>

All Government departments have a responsibility to comply with the Public Sector Equality Duty (PSED) under the Equality Act 2010.<\/p>

As such, when formulating any policy changes, Ministers must have due regard to the need to: (1) eliminate discrimination, harassment, victimisation and any other conduct prohibited by or under the Equality Act 2010, (2) advance equality of opportunity between persons who share a relevant protected characteristic and those who do not, and (3) foster good relations between people who share a protected characteristic and those who do not.<\/p>

Planning applications are decided in accordance with the development plan in place for the area, unless material considerations indicate otherwise. This is a matter for the relevant local planning authority to decide on a case-by-case basis.

The Government is clear that unauthorised development is unacceptable and unfair to the majority who abide by the rules.

Causing criminal damage to property is a criminal offence. The court must consider making a compensation order under section 130 of the Powers of the Criminal Courts (Sentencing) Act 2000 in any case where personal injury, loss or damage has resulted from the offence. It is an operational matter for the police, following advice from the Crown Prosecution Service, to decide whether or not an offence reaches the threshold required for prosecution under the relevant legislation.<\/p>

Property owners may also bring private legal proceedings to recover an award of damages for damage caused to their property by trespassers.
