The Windsor Framework removes 1,700 pages of EU law, and with them any European Court of Justice (ECJ) interpretation and oversight in those areas. Furthermore, the Stormont Brake would enable a sovereign UK Government decision to veto the application of new EU laws and accompanying ECJ oversight within Northern Ireland. This safeguard in the treaty itself is not subject to ECJ oversight, and any dispute on this issue would be resolved through subsequent independent arbitration according to international, not EU law.

In the limited circumstances in which EU rules do continue to apply, the UK and EU are clear that political routes should be used to seek to resolve issues before resorting to formal dispute settlement and that the fundamental underpinning of this arrangement is in international law, not EU law and the EU institutions.
"} , "answeringMember" : {"_about" : "http://data.parliament.uk/members/4210", "label" : {"_value" : "Biography information for Lord Ahmad of Wimbledon"} } , "answeringMemberPrinted" : {"_value" : "Lord Ahmad of Wimbledon"} , "dateOfAnswer" : {"_value" : "2023-03-23", "_datatype" : "dateTime"} , "isMinisterialCorrection" : {"_value" : "false", "_datatype" : "boolean"} , "questionFirstAnswered" : [{"_value" : "2023-03-23T17:22:15.983Z", "_datatype" : "dateTime"} ]} , "answeringDeptId" : {"_value" : "208"} , "answeringDeptShortName" : {"_value" : "Foreign, Commonwealth and Development Office"} , "answeringDeptSortName" : {"_value" : "Foreign, Commonwealth and Development Office"} , "date" : {"_value" : "2023-03-13", "_datatype" : "dateTime"} , "hansardHeading" : {"_value" : "European Court of Justice: Northern Ireland"} , "houseId" : {"_value" : "2"} , "legislature" : [{"_about" : "http://data.parliament.uk/terms/25277", "prefLabel" : {"_value" : "House of Lords"} } ], "questionText" : "To ask His Majesty's Government what changes to the role of the European Court of Justice in Northern Ireland will be made as a result of the Windsor Framework; and how any such change be implemented in law.", "registeredInterest" : {"_value" : "false", "_datatype" : "boolean"} , "tablingMember" : {"_about" : "http://data.parliament.uk/members/1388", "label" : {"_value" : "Biography information for Lord Dodds of Duncairn"} } , "tablingMemberPrinted" : [{"_value" : "Lord Dodds of Duncairn"} ], "uin" : "HL6397"} , {"_about" : "http://data.parliament.uk/resources/1603400", "AnsweringBody" : [{"_value" : "Foreign, Commonwealth and Development Office"} ], "answer" : {"_about" : "http://data.parliament.uk/resources/1603400/answer", "answerText" : {"_value" : "

The Government has acknowledged, as the Prime Minister did in his statement of 27 February, that the European Court of Justice (ECJ) is the final arbiter on matters of EU law. But by the EU's own calculations, less than 3 percent of EU rules with ECJ oversight apply under the Windsor Framework, with those that remain only applying to maintain maximum free trade and market access for NI firms. And the Windsor Framework narrows the application of EU rules in Northern Ireland, removing 1,700 pages of EU law, and takes with it any European Court of Justice interpretation and oversight in those areas. The agreement also introduces the Stormont Brake, which would enable a sovereign UK Government decision to veto the application of new EU laws and accompanying ECJ oversight within Northern Ireland. This safeguard in the treaty itself is not subject to ECJ oversight, and any dispute on this issue would be resolved through subsequent independent arbitration according to international, not EU law.
"} , "answeringMember" : {"_about" : "http://data.parliament.uk/members/4210", "label" : {"_value" : "Biography information for Lord Ahmad of Wimbledon"} } , "answeringMemberPrinted" : {"_value" : "Lord Ahmad of Wimbledon"} , "dateOfAnswer" : {"_value" : "2023-03-24", "_datatype" : "dateTime"} , "isMinisterialCorrection" : {"_value" : "false", "_datatype" : "boolean"} , "questionFirstAnswered" : [{"_value" : "2023-03-24T11:56:24.183Z", "_datatype" : "dateTime"} ]} , "answeringDeptId" : {"_value" : "208"} , "answeringDeptShortName" : {"_value" : "Foreign, Commonwealth and Development Office"} , "answeringDeptSortName" : {"_value" : "Foreign, Commonwealth and Development Office"} , "date" : {"_value" : "2023-03-13", "_datatype" : "dateTime"} , "hansardHeading" : {"_value" : "European Court of Justice: Northern Ireland"} , "houseId" : {"_value" : "2"} , "legislature" : [{"_about" : "http://data.parliament.uk/terms/25277", "prefLabel" : {"_value" : "House of Lords"} } ], "questionText" : "To ask His Majesty's Government whether the European Court of Justice will remain the final arbiter of EU law as it applies in Northern Ireland in the event that the Windsor Framework is implemented.", "registeredInterest" : {"_value" : "false", "_datatype" : "boolean"} , "tablingMember" : {"_about" : "http://data.parliament.uk/members/4216", "label" : {"_value" : "Biography information for Lord Empey"} } , "tablingMemberPrinted" : [{"_value" : "Lord Empey"} ], "uin" : "HL6399"} , {"_about" : "http://data.parliament.uk/resources/1600591", "AnsweringBody" : [{"_value" : "Foreign, Commonwealth and Development Office"} ], "answer" : {"_about" : "http://data.parliament.uk/resources/1600591/answer", "answerText" : {"_value" : "

We have accepted that Northern Ireland will, until the people of Northern Ireland vote otherwise, continue to have special access to the EU market. The minimal number of EU laws that remain - less than 3 percent - safeguard maximum free trade and market access for NI firms. That is something businesses have specifically asked us to protect.
