The Protection from Harassment Act 1997 allows the court, upon conviction or acquittal, to make a restraining order for the purpose of protecting the victim from conduct that amounts to harassment or that will cause fear of violence.<\/p>

The primary consideration of the court is that restraining orders remain necessary for the purpose of protecting the victim. When an application to vary a restraining order is made, the judiciary must consider the impact on the victim. Any application to vary must be shared with the victim to allow them to give their views before an order can be varied. All decisions on a variation are always communicated to the CPS, the police and the victim so that consideration can be made as to any additional protection that may be required. Departmental procedures require the police to receive notice within 30 minutes of an order being varied, so that they can take immediate steps if that is necessary.<\/p>"} , "answeringMember" : {"_about" : "http://data.parliament.uk/members/4362", "label" : {"_value" : "Biography information for Edward Argar"} } , "answeringMemberConstituency" : {"_value" : "Charnwood"} , "answeringMemberPrinted" : {"_value" : "Edward Argar"} , "dateOfAnswer" : {"_value" : "2018-11-20", "_datatype" : "dateTime"} , "isMinisterialCorrection" : {"_value" : "false", "_datatype" : "boolean"} , "questionFirstAnswered" : [{"_value" : "2018-11-20T16:42:52.533Z", "_datatype" : "dateTime"} ]} , "answeringDeptId" : {"_value" : "54"} , "answeringDeptShortName" : {"_value" : "Justice"} , "answeringDeptSortName" : {"_value" : "Justice"} , "date" : {"_value" : "2018-11-13", "_datatype" : "dateTime"} , "hansardHeading" : {"_value" : "Domestic Abuse: Restraining Orders"} , "houseId" : {"_value" : "1"} , "legislature" : [{"_about" : "http://data.parliament.uk/terms/25259", "prefLabel" : {"_value" : "House of Commons"} } ], "questionText" : "To ask the Secretary of State for Justice, what steps his Department is taking to ensure that victims of domestic abuse are protected in cases where their attacker's restraining order is varied.", "registeredInterest" : {"_value" : "false", "_datatype" : "boolean"} , "tablingMember" : {"_about" : "http://data.parliament.uk/members/3985", "label" : {"_value" : "Biography information for Robert Halfon"} } , "tablingMemberConstituency" : {"_value" : "Harlow"} , "tablingMemberPrinted" : [{"_value" : "Robert Halfon"} ], "uin" : "190858"} , {"_about" : "http://data.parliament.uk/resources/1006044", "AnsweringBody" : [{"_value" : "Ministry of Justice"} ], "answer" : {"_about" : "http://data.parliament.uk/resources/1006044/answer", "answerText" : {"_value" : "
