An EU regulation is adopted by a legislative procedure, i.e. by the ordinary legislative procedure or by a special legislative procedure, (see Article 289(3) of the Treaty on the Functioning of the European Union (TFEU)). The legal effect of an EU regulation is that it is directly applicable in the national law of all the Member States and it is binding in its entirety, (see Article 288 TFEU). The Government does not centrally hold information on each EU regulation issued since 1976. Article 4 of Regulation 1049/2001 regarding public access to European Parliament, Council and Commission documents sets out exceptions from the duty to provide access. These exceptions include those intended to protect internal deliberative processes where appropriate. For example, Article 4(3) allows documents to be withheld if they relate to a matter where the decision has not been taken by one of the three institutions, if disclosure of the document would seriously undermine the institution's decision-making process, unless there is an overriding public interest in disclosure.<\/p>

As set out in the Paymaster General\u2019s Written Ministerial Statement of 9 December 2021, officials in the Cabinet Office are continuing to undertake two reviews into retained EU law, one into the substance of retained EU law and one into its status in law.<\/p>

At the end of 2023, approximately 700 pieces of Retained EU Law (REUL) were revoked via schedule 1 of the Act (\u201cthe revocation schedule\u201d) and subsequent secondary legislation. Clause 3 of the EU (Withdrawal) Bill will convert direct EU legislation, including EU regulations, into domestic law so far as they are \u201coperative\u201d in the UK immediately before exit day. EU regulations which are in force before the UK\u2019s departure, but are stated to apply after exit day, will not be converted by clause 3.<\/p>
<\/p>
The government has announced its intention to negotiate an implementation period with the EU. The framework for this period would be the existing structure of EU rules and regulations. We will need to discuss with the EU the details of how the implementation period will work in practice during the next phase of negotiations. The implementation period will be given effect in domestic law through the Withdrawal Agreement & Implementation Bill.<\/p>
