The penalties for fly-tipping are on summary conviction: imprisonment for a term not exceeding 12 months or a fine or both; and on conviction on Indictment: imprisonment for a term not exceeding five years or a fine or both. The removal in 2015 of the £5,000 cap for maximum fines that magistrate\u2019s courts can impose, means that magistrates can hand down a potentially unlimited fine for a fly-tipping summary offence. In May 2016 we introduced fixed penalty notices of up to £400 for small-scale fly-tipping. This provides local authorities with an alternative to prosecutions and take a more proportionate enforcement response.<\/p>

<\/p>

In 2014 the Sentencing Council introduced new sentencing guidelines for environmental crimes, including fly-tipping. The guidelines were published to ensure a consistent approach to these offences is taken by courts in England and Wales. Requests for further guidance were received by the Sentencing Council from the National Fly Tipping Prevention Group, chaired by Defra, and the Environment Agency. This was due to concerns that the fines were not high enough to reflect the seriousness of the offences committed or to have a deterrent effect, and that there was an inconsistency in fine levels across the country. The guidelines encourage magistrates to make more use of the highest levels of fines for some of the more serious offences that come before the courts. It also helps sentencers more easily pitch a fine that is proportionate to the means of the offender.<\/p>

<\/p>

The Sentencing Council reviewed the effectiveness of the guidelines in 2016. The assessment showed that the level of fines for organisations has risen, but fines for individuals have not seen the same increase. We are looking into this and intend to work with the appropriate people in the court system for a consistent application of the guidelines.<\/p>

Defra\u2019s Equality, Diversity and Inclusion strategy sets out ambitious and comprehensive priorities to promote equality, diversity and inclusion in the Department, including \u2018supporting and empowering our networks and creating opportunities for people to share experience\u2019. Our strategy is supported by an annual communications plan setting out our priorities over the next 12 months and highlighting opportunities to raise awareness of equality, diversity and inclusion.<\/p>

We promote a range of nationally and internationally celebrated diversity calendar dates and events. British farming has a reputation for high animal welfare standards and strong environmental protections. Livestock farmers are meeting ever more demanding consumer expectations, and this focus on quality and provenance will help sell our produce at home and abroad.<\/p>

Defra is responsible for endemic disease issues in England. Alongside the Welsh Government and Scottish Government, it sponsors the Animal and Plant Health Agency (APHA), which provides services across Great Britain.<\/p>

<\/p>

APHA is monitoring the virus in Great Britain and working with veterinary professionals and the cattle and sheep sectors to raise awareness. The Agency works with officials in Northern Ireland and the EU to better understand the disease. It offers testing where there are reasonable grounds to suspect that cattle disease is caused by the virus. Preventing the spread of the disease is difficult as it is spread by midges, however there are two vaccines offering protection against the disease currently licenced in the UK, one of which is currently manufactured.<\/p>

The Government is committed to strengthening the rural economy, setting the right conditions for businesses to grow and thrive.<\/p>

The Industrial Strategy, published in November 2017, includes steps that will benefit rural businesses, such as access to finance and improved digital connectivity.<\/p>

<\/p>

The Rural Productivity Plan, published in 2015, set out a 10-point plan to boost rural economies. As part of this, enterprise zones have been established in rural areas.<\/p>

Last year, a new enterprise zone was created to help support local growth in Whitehill and Bordon, in particular local start-ups, SMEs, and high-growth businesses. These businesses will be able to benefit from the Bordon innovation centre newly opened in November, as part of the wider TechForest initiative.<\/p>

The £3.5 billion Rural Development Programme for England supports farmers, foresters and rural businesses and communities. In Hampshire, 41 projects worth a total of £1,296,519 have been agreed to date.<\/p>

Supporting UK businesses to export more is a top priority for this government.
