answer	answer is ministerial correction date of answer 09/03/2020 answer text <p>The CPS published updated legal guidance on gross negligence manslaughter in May 2019, to help make decision-making in these cases more transparent and to provide comprehensive and up-to-date guidance on the offence of gross negligence manslaughter in a medical setting, incorporating the recent relevant case law.</p><p> </p><p>Evidence of medical experts will be required in all cases of medical manslaughter. Experts have to be suitably qualified and are selected on the basis of having recent and relevant expertise on the area of medicine concerned. Experts are provided with terms of reference on the elements of the offence before providing their advice. For cases where a charging decision of gross negligence manslaughter is under consideration, the prosecutor and counsel will meet with the expert to discuss the report and the evidential test. answer	answer is ministerial correction date of answer 14/02/2018 answer text <p>DCMS is aware that a contract exists between the Marine Heritage Foundation (MHF) and Odyssey Marine Exploration and that MHF ​has also confirmed that there is no contractual arrangement with OME concerning any artefacts which may be recovered from the wreck of HMS Victory, which were not passed to MHF pursuant to a Deed of Gift dated 12 January 2012 between the Ministry of Defence and MHF. If any such artefacts are found, they will be notified to the Receiver of Wrecks to be dealt with according to law. MHF have also confirmed that the contract with OME does not require at any time in the future the de-accession or sale by MHF of artefacts from the wreck which, with their associated archive, will remain together as a single assemblage wherever possible.</p><p> </p><p>The UK Government has adopted the Key Management Principles in the Annex to the UNESCO Convention as best practice in the management of underwater archaeological and historic sites and this includes provisions regarding the incompatibility of commercial exploitation of cultural heritage for trade or speculation.</p> answering member constituency Northampton North answering member printed Michael Ellis question first answered 14/02/2018 16:38:05 answering member 4116 label Biography information for Sir Michael Ellis
