star this property answer text <p>Organisers of package holidays are required to comply with the Package Travel and Linked Travel Arrangements Regulations 2018. Consumers are entitled to a refund if they cancel a package holiday due to unavoidable and extraordinary circumstances occurring at the place of destination or its immediate vicinity which would significantly affect the performance of the package or transport to the destination, or if the organiser terminates the contract because of unavoidable and extraordinary circumstances.</p><p> </p><p>Given the evolving situation, the Competition and Markets Authority (CMA) has updated its guidance for businesses to help them understand their legal obligations. If the CMA finds evidence that companies are failing to comply with the law, the CMA will take appropriate enforcement action. For example, recent action from the CMA has led to an undertaking from TUI to refund affected customers by the end of September.</p>

As announced in the Queen’s Speech we will be bringing forward an Employment Rights Bill to deliver the greatest reform of workers’ rights in over 20 years.</p><p>These reforms include taking firm action to tackle what Matthew Taylor termed one-sided flexibility, where some businesses have transferred too much business risk to the individual, sometimes at the detriment of their financial security and personal well-being.</p><p>We will also give all workers the right to request a more stable contract, which aims to encourage conversations between employers and businesses.</p> more like this

star this property answer text <p>The Government recognises the critical role that post offices play in communities and for small businesses across the UK. This is why the Government committed to safeguard the post office network and protect existing rural services. The overall number of post offices across the UK remains at its most stable in decades with over 11,500 branches thanks to significant Government investment of over £2 billion since 2010.</p><p> </p><p>While the Government sets the strategic direction for the Post Office, it allows the company the commercial freedom to deliver this strategy as an independent business. The number of Crown Post Office which are either operational or closed throughout the UK is an operational matter for Post Office Limited. I have therefore asked Nick Read, the Group Chief Executive of Post Office Limited, to write to the hon Member on this matter. star this property answer text <p>The Government is clear that anyone entitled to be paid the National Minimum Wage (NMW) or National Living Wage (NLW) should receive it. We are committed to cracking down on employers who fail to pay the NMW/NLW.</p><p> </p><p>The current law makes clear that anyone who carries out “work” for an employer is entitled to the NMW/NLW. Where HMRC enforcement officers identify that there has been an underpayment, including for breaches related to unpaid working time, they may issue a Notice of Underpayment instructing the employer to pay the workers the arrears they are owed, and a penalty of up to 200% of those arrears.</p><p> </p><p>In cases where the total arrears are over £500, the Government considers publicly naming the employer via the NMW Naming Scheme. We publicly name in most eligible cases (almost 95%), and exemption from naming is only granted in the very limited circumstances set out in the NMW enforcement policy document on gov.uk.</p> more like this

star this property answer text <p>We define scaleups using the OECD definition of high growth, i.e. an enterprise with a cumulative average annual growth in employees or turnover greater than 20 per cent per annum over a three-year period, and with more than 10 employees at the beginning of the period.</p><p> </p><p>Scaleups play an important role in the UK economy: they generate around 20% of all turnover in the economy and around 15% of employment, and Scale Ups can play a role in driving innovation. The number of scaleups has risen overall by 25% over the 5 years to 2018 to 33,860.</p><p> </p><p>We have taken a number of actions to create the right conditions for businesses to achieve their potential to grow to scale, including:</p><ul><li>Supporting over £7bn of finance to over 91K smaller businesses through the British Business Bank (as at June 2019).</li><li>improving the support available through local Growth Hubs to help businesses to overcome the challenges they face in scaling up; and</li><li>using cutting edge data science techniques to identify high potential firms and connect them the right help at the right time.</li></ul>

star this property answer text <p>The Government is committed to tackling fraudulent practices in secondary ticketing. The department works closely with National Trading Standards to ensure they have adequate funding to tackle consumer detriment in the secondary ticketing market.</p><p> </p><p>As a result of this work, earlier this month two individuals from London were found guilty of fraudulently and dishonestly buying and reselling tickets for high-profile music and entertainment events. They have now been sentenced to a combined six and a half years in jail. This landmark case marks the first successful prosecution against the fraudulent reselling of tickets on a large scale. This is directly a result of the work of National Trading Standards, North Yorkshire County Council, and City of York Council.</p> more like this

star this property answer text <p>The Government recognises the importance of having a diverse range of pubs in local communities across the country, and the contribution pubs make to the economy and to community life in providing a place to socialise and encourage responsible drinking.</p><p> </p><p>In order to provide support for pubs, the Government announced a freeze on beer duty at Budget 2018. Due to this freeze, the price of a typical pint of beer in 2020 is 2p lower than it would have been had duty increased with inflation and 14p lower than it otherwise would have been since ending the beer duty escalator in 2013.</p><p> </p><p>Many pubs will benefit from the business rates retail discount announced at Budget 2018, which cuts bills for eligible businesses by one third for two years from April 2019. The Government has committed to increasing the discount to 50% in 2020/21. It is available to eligible businesses, including pubs, with a rateable value below £51,000.</p> more like this

star this property answer text <p>Through the National Minimum Wage (NMW) and National Living Wage (NLW), we are ensuring the lowest paid are fairly rewarded for their contribution to the economy. This April, the NLW will increase by 6.2% to £8.72, meaning that a full-time worker on the wage will see their pay increase by over £930 over the year. Young workers on the NMW will see their pay increase between 4.6% and 6.5%. Collectively, these increases to the minimum wage are estimated to directly benefit 2.4 million workers.</p><p> </p><p>In setting these rates, the Government consider the expert and independent advice of the Low Pay Commission (LPC). The LPC draws on economic, labour market and pay analysis, independent research and stakeholder evidence, to assess the impact of past minimum wage increases and their proposed rates for the following year.</p><p> </p><p>To date, the LPC have found that the minimum wage has increased pay for the lowest earners without harming employment. They will publish their 2020 report later this year, which will contain a further assessment on the impact of the latest increases.</p>

star this property answer text <p>The Government-backed British Business Bank helps to drive economic growth by making finance markets work better for smaller businesses, enabling them to prosper and grow. The British Business Bank is currently supporting over £7.2bn of finance to over 93,000 SMEs across the UK (as at September 2019). The Bank’s Online Finance Hub offers independent and impartial information on different finance options, helping smaller businesses to identify the right finance options for their needs.</p><p> </p><p>The Bank’s Start Up Loans programme has delivered over 69,000 loans worth over £565m since it was established in 2012. In Harlow, the programme has delivered 75 loans worth over £598,000. Each Start Up Loan comes with 12 months free mentoring and support.</p><p> </p><p>Harlow has also been invited to develop proposals a Town Deal of up to £25 million. The new Town Board met for the first time in January and is developing a Town Investment Plan. The Towns Fund will address various town centre issues, including business environment.</p><p> </p><p>The objective of the Towns Fund is to drive the economic regeneration of towns to deliver long term economic and productivity growth, including through ensuring towns have the space to support small business development.</p><p> </p><p>Harlow Enterprise Zone (EZ) is one of 45 government-designated EZs which aim to incentivise small business start-ups and growth principally by offering business rates relief and simplified planning. Key objectives include attracting increased inward investment, and the creation of job opportunities for local residents.</p><p> </p><p>Government supports a network of 38 Growth Hubs across England, which offer free expert advice to on the most suitable business finance as well as access to regional and national organisations and networks. Businesses in Harlow and across Essex are encouraged to access support and advice at South East Business Hub<sup><sup>[1]</sup></sup><sup>.</sup></p><p> </p><p>Harlow firms are also encouraged to access the BEST (Essex) Growth Hub. Although physically based in Southend, the Growth Hub’s services are available to Harlow businesses.</p><p> </p><p>The recently launched Government’s own Business Support Website brings together on one new and easy-to-use site, information, support and advice to businesses in England. The support is organised around four themes: Finance and business planning; Leadership and talent; Innovation and technology; and Exporting. star this property answer text <p>HM Land Registry (HMLR) receives 120,000 applications per day, of which 95% are processed within the service standard of 5 days for register updates (to an existing title) and 25 days for more complex applications that require the creation of a new title (for example on the first registration of a property or a new lease). There is a backlog of some complex casework involving the creation of a new title, which account for 5% of applications.</p><p> </p><p>HMLR recognise that this situation needs addressing and are implementing plans to reduce the waiting times for those cases. These applications relate to an already completed property transaction but HMLR will expedite cases where necessary to avoid adverse impacts on customers.</p> more like this

star this property answer text <p>The Government recognises that widespread access to cash remains extremely important in the context of bank closures, particularly for the more vulnerable and remote customers and businesses. The Government supports the renegotiated Banking Framework agreement, which is a three-year agreement and took effect in January 2020. This agreement enables 99% of personal banking customers and 95% of business banking customers to do their day-to-day banking at the Post Office, including cash withdrawals.</p><p> </p><p>In addition, LINK, the main provider of ATMs in the UK, has assured Government that they are committed to maintaining an extensive network of free-to-use cash machines, including via Post Offices, and bolstering its Financial Inclusion Programme.</p> more like this

star this property answer text <p>The rights of UK nationals who wish to continue living in the EU beyond 31st December 2020 have been secured through the Withdrawal Agreement. UK citizens living and working in the EEA or Switzerland by the end of the transition period can bring their close family members back to the UK with them under current conditions, to enable their family members to apply to the EU Settlement Scheme, until 29 March 2022, as long as the relationship was formed by 31 January 2020. We will continue to maintain up-to-date guidance on the Gov.uk website for any UK national living abroad who is considering returning to the UK. We would welcome UK nationals of whatever skill level who wish to return to the UK, whether from within or beyond the EU.</p> more like this

HMRC follows up on every worker complaint it receives, even those which are anonymous. The Government publishes a regional breakdown of National Minimum Wage enforcement activity, including arrears and penalties, as part of the annual Enforcement and Compliance Report. The most recent report can be found <a href="https://www.gov.uk/government/publications/national-living-wage-and-national-minimum-wage-government-evidence-on-compliance-and-enforcement-2019?utm_source=c1be9ead-a906-4fe7-ba50-f499bf80967a&amp;utm_medium=email&amp;utm_campaign=govuk-notifications&amp;utm_content=immediate" target="_blank">here</a>.</p><p> </p><p>Caution is required when analysing Minimum Wage enforcement by geography. Enforcement data is reported based on employers’ details, not workers’. This means HMRC may identify arrears for workers who live outside of the immediate area where their employer is based. Similarly, for large employers, arrears and penalties may be attributed to a specific head office location.</p>

star this property answer text <p>Existing legislation limits noise from fireworks available to consumers to a maximum of 120 decibels. Consumers can also choose to buy from a range of fireworks with lower noise levels.</p><p>The Office for Product Safety and Standards (OPSS) has been developing a fact-based evidence base on the key issues that have been raised around fireworks. This includes noise as well as anti-social behaviour, non-compliance, environmental impact, and the impact on humans and animals. This will build a full picture of the data around fireworks in order to identify whether, and what, further action is appropriate.</p> more like this

star this property answer text <p>The Government is clear that anyone entitled to be paid the National Minimum Wage (NMW) or National Living Wage (NLW) should receive it. We are committed to cracking down on employers who fail to pay the NMW/NLW.</p><p> </p><p>It is important to ensure that all working time is considered for minimum wage purposes. Employers are responsible for recognising and recording all working time for their workers. However, not all time constitutes working time. Government guidance entitled Calculating the Minimum Wage provides further information.</p><p> </p><p>A work trial that it is for recruitment purposes and that it is reasonable and not of excessive duration would probably not constitute “work” under a worker’s contract. An unpaid trial lasting more than one day is probably illegal in all but exceptional circumstances and would therefore entitle the individual to be paid at least the minimum wage.</p> more like this

Compliance is Companies House’s primary aim, rather than prosecution. It is taking action to ensure that all SLPs report their PSC information. Companies House is actively engaged with SLPs and their representatives to make them aware of their responsibilities. Failure to comply with the requirement to report PSC information does not incur a civil penalty but it is an offence and may lead to a fine or imprisonment upon prosecution. Companies House is not a prosecuting body and will refer cases to a relevant prosecutor when all other avenues have been exhausted and an SLP has not complied with their obligations.</p> more like this

star this property answer text <p>All registered Scottish Limited Partnerships (SLPs) are required to comply with the Scottish Partnerships (Register of People with Significant Control) Regulations 2017. As of 31 January 2020, there were 34,245 live<sup>1</sup> Scottish limited partnerships (“SLPs”) on the register. Of these, Companies House considers around 10,800 of these SLPs to be active. These regulations also require a Scottish qualifying partnership (SQP) to register with Companies House and deliver information concerning its People with Significant Control (PSC). A SQP is a general partnership constituted under the law of Scotland that is a qualifying partnership under the Partnership (Accounts) Regulations 2008. As at the end of January 2020, there were 330 Scottish Qualified Partnerships bodies that declared as being eligible as SQPs.</p><p> </p><ol><li><em>Live Scottish Limited Partnerships refers to Scottish Limited Partnerships that are not dissolved/closed. Under current legislation, Scottish Limited Partnerships are unable to dissolve/close or be removed from the register. Therefore, this will include on the register a significant volume that have not carried out any activity.</em></li></ol>

star this property answer text <p>When we laid the Parental Bereavement Leave and Pay Regulations in January, the policy received extensive coverage across broadcast, print and digital media. This announcement will have reached thousands of parents.</p><p> </p><p>Ahead of Parental Bereavement Leave and Pay coming into force, the Department for Business, Energy and Industrial Strategy will publish guidance on GOV.UK to help parents and their employers to understand the new entitlement. We have ensured that employers are aware of Parental Bereavement Leave and Pay by including regular articles in the HM Revenue and Customs Employer Bulletin and Agent Update publications about this. We are also working closely with the Advisory, Conciliation and Arbitration Service (ACAS) to reflect the introduction of the new entitlement in their employer support guidance. We will also continue to work closely with bereavement support organisations such as Cruse Bereavement Care, Child Bereavement UK and SANDS to ensure that they are able to support bereaved parents to use the new entitlement.</p><p> </p>

star this property answer text <p>While publicly owned and accountable to Government for its decisions, Post Office Ltd operates as an independent, commercial business and management of the roll-out of the Horizon accounting system falls within the scope of the Post Office’s responsibilities.</p><p> </p><p>Since 2004, United Kingdom Government Investments, previously known as the Shareholder Executive, has acted as Shareholder Representative for BEIS, overseeing POL’s corporate governance, strategy, and the stewardship of POL’s financial resources on behalf of the shareholder. Prior to 2004, this role was carried out by the Department for Trade and Industry.</p><p> </p><p>It is important that Government takes the Post Office’s relationship with postmasters very seriously and closely monitors the situation. The Post Office, through its new CEO has since accepted he got things wrong. He has apologised and said it aims at establishing a positive relationship with its postmasters. BEIS is working actively with the Post Office on this matter and will hold them to account on their progress.</p><p> </p>

star this property answer text <p>The Government is committed to supporting working parents.</p><p> </p><p>We recognise the particular challenges faced by parents of over 100,000 babies admitted into neonatal care each year, many of whom are born prematurely.</p><p> </p><p>Our Manifesto committed to give parents of babies in neonatal care a new entitlement to paid leave from work.</p><p> </p><p>Following our consultation on this last year, we are analysing the responses as a priority and will set out our plans soon.</p> more like this

star this property answer text <p>Government is unable to comment on individual cases given that the Criminal Case Review Commission (CCRC) is independent in their determination of applications. The CCRC is working hard to progress these cases at speed though and is treating the cases as a group to enable them to review the cases more efficiently. However, within the group of cases the CCRC will still need to assess each case individually, so that they can make a decision as to whether the case meets the statutory test to be referred to the appeal courts. Post Office Ltd has assured Government that it is fully cooperating with the CCRC. ​</p><p> </p><p>More widely in respect of the Horizon case, the Post Office, under its new chief executive officer, has accepted that it got things wrong, apologised and said that it aims to re-establish a positive relationship with postmasters. The Department for Business, Energy and Industrial Strategy is working actively with the Post Office on this matter and will hold it to account on its progress. We are also looking into what more needs to be done.</p>
