star this property answer text <table><tbody><tr><td><p>The tables below show total Government expenditure on legal aid between 2005-6 and 2018-19 in nominal and real terms The information requested is not available for the period prior to 2005-6 as each series is presented as far back in time as it can be produced on a basis that is comparable with the most recent figures. Beyond this, measures of overall expenditure may not be directly comparable because the way legal aid is administered and public money is managed and accounted for have changed. In February, the government published the Legal Support Action Plan which committed to a number of changes to legal aid, including improving the Exceptional Case Funding scheme, expanding the scope of legal aid to all special guardianship orders in private family law, and removing the means test for those with parental responsibility who wish to oppose adoption and placement orders. In addition, we are reviewing the legal aid means testing framework to ensure that those who need legal aid are able to access it into the future. RDEL (Resource Departmental Expenditure Limit) is current expenditure from within the annual Departmental Expenditure Limits that are set by the Treasury for each government department, and is used in the MoJ and LAA Annual Report &amp; Accounts. It aims to measure the value of all work carried out in each period, regardless of whether it is on cases that have finished. RDEL excludes AME (hence so do the budgeting measures shown in the table). AME (Annually-Managed Expenditure) broadly covers unpredictable or uncontrollable expenditure. In legal aid terms this is work in progress where the payment date is unknown. It can be negative for individual years. In 2013-14, responsibility for Central Funds spending transferred from the Ministry of Justice to the Legal Aid Agency. From October 2014 a new administrative system has enabled these statistics to be based on the general ledger prior to accounting adjustments, and therefore from 2015-16 they are no longer identical to the RDEL figures.</p></td></tr></tbody></table>

star this property answer text <table><tbody><tr><td><p>The Government is working closely with a broad group of expert stakeholders to develop a new accessible IT Service. This will support and enable both represented and unrepresented claimants to progress Road Traffic Accident related personal injury claims under the new small claims track limit of £5,000. The Government’s key design principle in approaching the development of the new IT service is that that the claimant and access to justice must be at the heart of the process and the new service must be as simple and efficient as possible for unrepresented claimants to make, progress and settle their claims online without the need to go to court. In addition, unrepresented claimants will also have access to a bespoke alternative dispute resolution scheme, which will enable them to gain, at no cost to themselves, an independent view on the liability decision made by the defendant insurer. The service will also provide claimants with guidance, so that claimants can understand and navigate the IT Service without unnecessary delay.</p></td></tr></tbody></table><p>Claimants however, will not be precluded from having legal representation at any point of the process, but will be liable to pay for a lawyer.</p>

star this property answer text <table><tbody><tr><td><p>As with all prisoners, those serving Imprisonment for Public Protection (IPP) sentences are not refused access to offending behaviour courses based on their sentence type. We use risk, needs and responsivity principles to help us target the right programmes for the right people. This ensures that the level of support provided by a programme matches a person’s risk of reoffending and that the content covers the areas a person needs to address to reduce further offending. All prisoners, including those serving IPP sentences, have their suitability for any accredited programmes considered as part of their wider sentence plan. A wide range of accredited programmes are available in custody and these are refreshed annually based on prisoner needs and demand. IPPs are one of the groups prioritised for participation on suitable programmes. However, completion of accredited programmes is not a mandatory requirement in order for IPP prisoners to secure release. Information related to the number of offenders serving an IPP that have been referred, but not found suitable for courses could only be obtained at disproportionate cost.</p></td></tr></tbody></table>

star this property answer text <table><tbody><tr><td><p>All regime management matters lie with Contractors. Regime Management Plans are only required for public sector prisons. However, operators of privately managed prisons are required to ensure they maintain a safe, decent and secure prison as per their contractual obligation. The performance of all providers continues to be robustly managed. We will not hesitate to take action if and when standards fall short.</p><p> </p><p>Each privately managed prison has a full-time on-site Controller employed by HM Prison and Probation Service (HMPPS) whose role it is to monitor performance at the prison across a range of indicators. If the contract management team are concerned that outcomes are affected by problems related to regime management, then this will form part of contract management processes and this will be raised with the provider. If we require outcomes to be improved we will expect that action by the provider will address regime matters.</p></td></tr></tbody></table>
