answer	answer is ministerial correction date of answer 06/03/2018 answer text <p>Accommodation will be provided to immigration bail applicants if the person does not have adequate accommodation or the means of obtaining it – whether from a public body under different legislative powers or through their own efforts - and the provision of accommodation is necessary in order to avoid a breach of their human rights under Article 3 of the European Convention on Human Rights.</p><p>However, accommodation should only be provided if it is clear that the person cannot reasonably be expected to leave the UK. answer	answer is ministerial correction date of answer 29/01/2018 answer text <p>Section 4(1) of the Immigration and Asylum Act 1999 was repealed on 15 January on the coming into effect of new immigration bail provisions in Schedule 10 to the Immigration Act 2016, including new powers to provide accommodation in certain circumstances. The repeal of section 4(1) is not expected to have any discernible effect on the number of people released from immigration detention on immigration bail</p><p>There has been communication with the First-tier Tribunal about the implications of Schedule 10 to the 2016 Act, including the repeal of section 4(1) of the 1999 Act and provision of bail accommodation. Regular discussions have also taken place with Ministry of Justice officials from both HM Courts and Tribunals Service and HM Prisons and Probation Service. No discussions on this subject have taken place with the Secretary of State for Housing, Communities and Local Government or Ministers in the devolved administrations. <br>Section 4(1) of the 1999 Act was used to provide accommodation to people released from immigration detention on bail and in limited circumstances to other categories of migrants who required support in order to avoid a breach of their rights under Article 3 of the European Convention on Human Rights</p><p>Paragraph 9 of Schedule 10 to the 2016 Act replaces this with powers to provide accommodation to people released from detention on bail and to those who require it in order to avoid a breach of their Article 3 rights</p><p>Additionally, individuals granted immigration bail who are asylum seekers or failed asylum seekers still have access to support provided under sections 95 or 4(2) of the 1999 Act if they would otherwise be destitute and meet the normal eligibility criteria. answer	answer is ministerial correction date of answer 29/01/2018 answer text <p>The Home Office is committed to ensuring that destitute asylum seekers are accommodated in safe, secure and suitable accommodation whilst their claims are considered and have worked closely with accommodation providers to develop improvements to the service over the lifetime of the contract. The Home Office does not publish data on the number or cost of welfare officers or property management staff employed by asylum accommodation providers, however proposals for additionally funded service provision from each of the provider’s have been assessed and approved. It is a matter for individual providers to utilise the available funding as they deem appropriate. It is not possible to list a specific set of roles requiring criminal records checks as job roles will vary from one provider to another, however all roles which include contact with service users will be subject to an appropriate level of check depending on the specifics of the role</p><p>Criminal record checks are obtained through the Disclosure and Barring Service (DBS). The DBS publishes details and guidance for employers on eligibility and levels of clearance required for roles that may be deemed as sensitive as a result of working with children and adults. As part of the wider Government Commercial Function, the Home Office receives market intelligence from the Markets and Suppliers team, and the department works closely with Crown Representatives who operate at board level with our strategic suppliers and provide insights into company strategy and issues. The Home Office has applied this process in assessing the impact of the Carillion liquidation.</p><p>All Home Office contracts are tendered in compliance with the EU Procurement Directives and as part of its tendering process an assessment of financial viability is undertaken, which is in line with best practice and Cabinet Office guidance. The assessment is proportionate to the risk of the procurement being undertaken and is completed on each bidder by independent qualified accountants. The outcomes are considered within the normal tendering governance processes. answer	answer is ministerial correction date of answer 15/01/2018 answer text <p>The Government is providing funding of up to £2.5 million from the local services element of the Controlling Migration Fund (CMF) which is administered by the Ministry of Housing, Communities and Local Government (MHCLG).</p><p>The funding made available for this scheme comes from an existing MHCLG budget; it is not new funding. Therefore Barnett consequentials do not apply.</p><p>The Government has no plans or remit to extend the scheme to local authorities in the devolved nations, which have their own funding arrangements in this area including through the Immigration Enforcement part of the CMF.</p><p>Funding is available for 2018/19 and the Government intends to publish its plans for the national evaluation of the scheme in due course.
