answer text <p>The Department follows the procurement policy on tax compliance for contracts over £5 million.</p><p>However, MHCLG’s procurement team are not aware of any supplier having been excluded from a procurement process for non-compliance with PPN 03/14. As the Department does not maintain a record of decisions such as this, it is not possible to state categorically that the department has or has not excluded suppliers from procurement process for contracts over £5 million since 2014.</p> more like this

answer text <p>We take the protection of personal data very seriously, particularly when it relates to children and young people. Apps that process personal data must comply with the General Data Protection Regulation (GDPR) and the Data Protection Act 2018.</p><p> </p><p>Apps that offer online services need to obtain parental consent to the processing of personal data for children who are under the age of 13. By law they must also make reasonable efforts to verify that the person providing consent holds parental responsibility for the child. Organisations which fail to comply with this obligation may be subject to enforcement action by the Information Commissioner’s Office (ICO).</p><p> </p><p>The Data Protection Act 2018 also introduced a requirement for the ICO to produce a statutory code of practice on age-appropriate design. This code will ensure websites and apps are designed in a way that makes clear what data is being collected on children, how this data is being used, and how both children and parents can stay in control of this data.</p><p> </p><p>The ICO’s consultation on the age-appropriate design code of practice closed on 5 December 2018. Further information about the consultation is available on the ICO’s website at ico.org.uk</p>

answer text <p>Procurement rules require the Department to exclude any supplier for non-payment of taxes if the breach is established by a court ruling. Information is not collated centrally on companies excluded from bidding for the Department as a result of prosecutions or convictions in relation to the payment of taxes. Officials are not aware of any such cases.</p><p> </p><p>Cabinet Office’s Procurement Policy Note 03/14, published in 2014, set out questions that central government departments should use for the Pre-Qualification Questionnaire (PQQ) phase of procurement exercises likely to be £5 million or more in value. These are used to gather information on and make assessments of prospective bidders' suitability, before considering tenders; Note 03/14 introduced questions to gather information about companies' track records including declarations around payment of taxes.</p><p> </p><p>These questions now form part of the Standard Selection Questionnaire (SQ), the successor to the PQQ, introduced by the Cabinet Office and Crown Commercial Service in 2017 under Procurement Policy Note 8/16.</p>
