answer	answer is ministerial correction date of answer 12/11/2018 answer text <p>The Public Services (Social Value) Act 2012 places a requirement on commissioners, including local authorities, to consider the social, economic and environmental benefits of their approaches to services contracts before the procurement process starts. The existing scheme of UK procurement rules, which implement the EU public procurement directives, are preserved under the European Union (Withdrawal) Act 2018 when the UK leaves the European Union, with relevant adjustments necessary to ensure legal operability. This will give legal certainty and continuity to businesses, contracting authorities, and employees, on day one of Exit. Evidence provided to the Strategy suggested that the requirements of the Public Services (Social Value) Act 2012 are often treated as an afterthought. Our engagement included focused workshops with a number of local authorities and their stakeholders, to explore opportunities of and barriers to social value in the procurement process. This requires that councils publish a range of data, including that on procurement and contracts. Here councils are required to publish data on invitations to tender for contracts over £5000 and contracts awarded over £5000 are published on a quarterly basis. As independent contracting authorities, local authorities are responsible for taking their own procurement decisions. answer	answer is ministerial correction date of answer 17/10/2017 answer text <p>Local authorities contemplating the use of their compulsory purchase powers to acquire land and properties should consider, amongst other things, whether there is a compelling case in the public interest for doing so. They should also take account of government's guidance on the compulsory purchase process, which was published in October 2015.</p><p>The Local Government Act 1999 (Part 1, Section 3) requires an authority to carry out the functions designated to it in accordance with the ‘best value duty’. This requires that &quot;A best value authority must make arrangements to secure continuous improvement in the way in which its functions are exercised, having regard to a combination of economy, efficiency and effectiveness”. The duty applies to the full range of an authority’s activities.</p><p>Local authorities have the freedom to borrow and invest, including in land and property purchases, without government consent, provided that their borrowing is affordable. Control is exercised through four statutory codes that local authorities are required to have regard to, two prepared by the Chartered Institute of Public Finance and Accountancy (CIPFA) and two prepared by DCLG. This framework is known as the “Prudential System”.
