answer text <p>At the end of 2023, approximately 700 pieces of Retained EU Law (REUL) were revoked via schedule 1 of the Act (“the revocation schedule”) and subsequent secondary legislation. Unless actively revoked, no REUL was sunset and instead became “assimilated law” after the end of 2023.</p><p> </p><p>The Retained EU Law Dashboard is the government’s public catalogue of each piece of REUL confirmed by government departments, and their status. The dashboard currently features 5020 pieces of REUL and will be updated in January 2024, in line with our statutory commitments in the REUL Act and alongside the forthcoming first REUL parliamentary report.</p> more like this

answer text <p>The scope of the sunset is defined in clause one and it covers ‘EU-derived domestic subordinate legislation’ and ‘retained direct EU legislation’.</p><p>Primary legislation will not sunset.</p><p>Clause 1 also contains the preservation power. This allows the UK Government and devolved governments to preserve specific pieces of retained EU law that would otherwise be subject to the sunset.</p> more like this

answer text <p>Retained EU Law, as introduced into UK law through the European Union (Withdrawal) Act 2018 (EUWA), is subject to complex glosses associated with EU legal principles, which confer a special status on retained EU law. This includes the principle of supremacy, which continues to apply in domestic law, and means some retained EU law takes priority over ordinary domestic law, including Acts of Parliament, in the event of conflict. This is no longer appropriate given we have left the EU.</p> more like this

answer text <p>The Retained EU Law (REUL) Dashboard, published in June 2022, lists the 2,417 pieces of REUL identified at that point in time. This Dashboard will be updated on a quarterly basis as REUL is repealed and replaced, or more REUL is identified.</p><p> </p><p>The Department for Business, Energy and Industrial Strategy has worked closely with The National Archives on the underlying dataset. As part of this, the Department has asked The National Archives to search their archive for REUL that is no longer associated with an existing ministerial department. The aim of this work is to ensure that all REUL has been identified and the results will be added to the REUL dashboard.</p> more like this

answer text <p>Defra has already reformed Retained EU Law in key areas through flagship legislation such as the Environment Act, Fisheries Act and Agriculture Act. answer text <p>This government is making the most of our new found freedom to reform, repeal and replace outdated retained EU law that does not serve the interests of the UK. We are creating a regulatory environment which will promote growth, innovation and prosperity, cutting at least £1 billion of red tape for businesses, while maintaining the high standards the British people rightly expect.</p><p>Cabinet Office is leading and coordinating the programme of work being undertaken by Secretaries of State across government, to identify and deliver the regulatory and economic opportunities that Brexit has provided. No staff within the Brexit Opportunities Unit in the Cabinet Office monitor how the EU chooses to diverge from the UK.</p><p>The Government monitors significant EU policy developments that are likely to affect UK interests, to ensure compliance with the Trade and Cooperation Agreement and support business readiness as necessary. My officials and I undertake regular engagement with the Devolved Administrations on the opportunities arising from leaving the EU, using Common Frameworks and other existing intergovernmental structures.</p><p><strong></strong><br><br></p><p> </p>
