answer text <p>The Anti-Corruption IMG last met in March 2017, co-chaired by Minister for the Cabinet Office Ben Gummer MP and the Prime Minister’s Anti-Corruption Champion Sir Eric Pickles MP. Following the publication of the anti-corruption strategy, membership is being revised to ensure effective ministerial oversight of Strategy priorities. I can confirm that it will be constituted by Ministers and senior representatives from all relevant Departments and law enforcement agencies, and the Prime Minister’s Anti-Corruption Champion, and will meet in the Spring.</p> more like this

answer text <p>The United Kingdom’s law enforcement response to corruption is robust, and the UK has been recognised by Transparency International (TI) as one of only four active enforcers of the OECD anti-bribery convention. Since the Summit, the Serious Fraud Office (SFO) has secured two corruption-related Deferred Prosecution Agreements, including against Rolls Royce. The SFO has also secured convictions of individuals on bribery and corruption charges, and has opened a number of other criminal investigations, with five trials due to be held in the next twelve months.</p><p>In parallel, the National Crime Agency (NCA) continues to pursue numerous investigations into the most serious allegations of international bribery, corruption, financial sanctions evasion and associated money laundering offences. At the Summit, the NCA also committed to establishing a new International Anti-Corruption Coordination Centre based in London, with the intention of it being operational by April 2017. The Centre will bring together specialist law enforcement officers from multiple foreign jurisdictions into a single location to tackle allegations of grand corruption.</p><p> </p><p> </p><p> </p><p> </p>

answer text <p>Official data regarding prosecutions are held by the Ministry of Justice, but the department does not record it in a form which allows it to distinguish between overseas bribery and domestic bribery.</p><p> </p><p>Whilst not official data, the Crown Prosecution Service (CPS) and the Serious Fraud Office (SFO) record data for their own management information purposes. In the last five years, the SFO has successfully prosecuted three British companies and 10 individuals, nine of whom were British citizens, for bribery or corruption overseas (offences under the Bribery Act 2010 or the Prevention of Corruption Act 1906).</p><p> </p><p>In addition to this the SFO has secured three Deferred Prosecution Agreements with British companies in the past two years for overseas corruption offences. The first agreement included a financial penalty of $25m, plus SFO’s full costs; the second resulted in financial orders of £6.6m and the most recent one was for £497.25m plus interest, as well as a payment of the SFO’s full costs.</p><p> </p><p>CPS’s data measures the outcome of prosecutions against defendants but not on the outcome against individual offences. This information could only be obtained by examining CPS case files, which would incur disproportionate cost.</p>

answer text <p>The UK has corporate criminal liability and commercial organisations can be, and are, prosecuted for wrongdoing. The UK Anti-Corruption Plan tasked the Ministry of Justice to examine the case for a new offence of a corporate failure to prevent economic crime and the rules on establishing corporate criminal liability more widely. Ministers have decided not to carry out further work at this stage as there have been no prosecutions under the model Bribery Act offence and there is little evidence of corporate economic wrongdoing going unpunished.</p> more like this
