answer text <p>The Department are undertaking legal action against Grey GR, a subsidiary of Railpen.</p><p>The Department wrote to Grey GR regarding Cardinal Lofts and Timblebeck in November 2022 and February 2023, and again regarding Cardinal Lofts in March 2023, concerning the safety of residents. Departmental officials last met with Railpen officials today.</p><p>A copy of the Secretary of State’s correspondence will be placed in the Library of the House.</p><p>Building owners are legally responsible for making sure their buildings are safe. Should the residents of an unsafe building need to be evacuated, the Government expects building owners to provide suitable alternative accommodation until residents can return home, at the building owner's expense, and for the building to be remediated.</p><p>Regarding non-qualifying leaseholders we continue to monitor closely the remediation of all buildings in receipt of public funding, such as from the Building Safety Fund. For those buildings where the developer or freeholder have agreed to remediate, no costs should be attributable to leaseholders, whether qualifying or non-qualifying for other costs. Parliament determined a way forward on this matter in 2022 which we continue to monitor.</p>

answer text <p>Under the existing regulatory framework for construction products, there is no obligation on 'economic operators' (manufacturers, importers and distributors) to certify that a product is safe to be used in the construction of buildings.</p><p>It is our intention to address this safety gap and make sure that all construction products available on the UK market fall under a regulatory regime. The Building Safety Act creates powers to make regulations to require products to be safe before they are placed on the UK market. It will also bring the regulation of products identified as being safety critical in line with arrangements for products that are covered by the existing regulatory regime. These new regulations will be underpinned by a strengthened market surveillance and enforcement regime.</p><p>All building works must comply with the requirements of the Building Regulations 2010 not limited to, but including, safety related performance requirements.</p> more like this

answer text <p>We are clear that building owners and industry should make buildings safe without passing on costs to leaseholders, and leaseholders living in their own medium and high-rise buildings should not have to pay to remediate historic cladding defects that are no fault of their own. We have further clarified that we have no intention of excluding leaseholders who have moved out and sublet from protections that will be put in place (including those in shared ownership) for buildings over 11 metres in England. We will explore whether this support should extend to other leaseholders, such as buy-to-let landlords. We are also bringing forth statutory protections in the Building Safety Bill to ensure leaseholders are protected.</p><p> </p> more like this

answer text <p>The Government has always been clear that a risk-based professional judgement should be made regarding the safety of a building's external wall system and would encourage building owners to consult a competent professional who will be able to advise.</p><p>A number of factors should be considered when considering the external walls of buildings such as building height, cavity barrier provision, ability to pass a large-scale test (i.e., BS 8414/BR135) and consideration of other fire safety measures such as sprinklers. We cannot comment on specific building situations, however we would always encourage those undertaking these assessments to use an approach proportionate to the level of risk in each building.</p><p>We are developing more risk-proportionate guidelines for fire risk assessors, including PAS 9980 and new statutory fire safety guidance.</p> more like this

answer text <p>Building safety is the responsibility of the building owner, and we expect remedial works to progress at pace.</p><p>For the removal of unsafe ACM cladding from high-rise residential buildings the Government has provided £600 million in funding. We have made progress, and as a result of our action, across all sectors, 209 buildings have either completed remediation or have had their ACM cladding systems removed. It is our ambition that all remaining building owners have works on site by the end of 2020, with completion of remedial works by the end of 2021.</p><p>The Government will provide £1 billion in 2020/21 to support the remediation of unsafe non-ACM cladding systems on high-rise residential buildings in both the private and social sectors.</p> more like this
