If a landlord does not provide a valid landlord's certificate within 4 weeks of a leaseholder requesting a certificate (if necessary, via the managing agent), they will be unable legally to pass costs for remediation onto qualifying leaseholders. <br> <br> A leaseholder can evidence they qualify to receive the protections from remediation costs in the Building Safety Act by completing a leaseholder deed of certificate. While there is no additional funding for businesses affected by necessary remediation works, we do expect companies in these buildings to be consulted about proposed repairs. We have further clarified that we have no intention of excluding leaseholders who have moved out and sublet from protections that will be put in place (including those in shared ownership) for buildings over 11 metres in England. We will explore whether this support should extend to other leaseholders, such as buy-to-let landlords. answer	answer is ministerial correction date of answer 04/11/2021 answer text <p>The Government has always been clear that a risk-based professional judgement should be made regarding the safety of a building's external wall system and would encourage building owners to consult a competent professional who will be able to advise.</p><p>A number of factors should be considered when considering the external walls of buildings such as building height, cavity barrier provision, ability to pass a large-scale test (i.e., BS 8414/BR135) and consideration of other fire safety measures such as sprinklers. We have made progress, and as a result of our action, across all sectors, 209 buildings have either completed remediation or have had their ACM cladding systems removed.
