answer text <p>The provider must meet certain conditions before the provider can redistribute any surpluses. These conditions will be set out prior to contract award and relate to the provider’s financial status and liabilities, quality measures and contract performance. If conditions are met, the provider can distribute surpluses in the form of dividends or non-contractual bonuses.</p><p> </p><p>Dudley’s Multi-specialty Community Provider prospectus reflects an expectation on the part of commissioners that any overall surpluses should be reinvested in local service provision.</p> more like this

answer text <p>The commissioner – in this case Dudley Clinical Commissioning Group (CCG) – is solely responsible for carrying out the procurement and it will be for the commissioner to determine break points, penalties, compensation and arrangements to ensure continuity of service.</p><p> </p><p>As with all standard National Health Service contracts, we would expect any multi-speciality community provider (MCP) contract to set out the circumstances in which the contract may be terminated by either party and the process following termination. It will be for the CCG to determine where the break points should be, factoring in the potential impacts on value for money. In accordance with the existing terms of the NHS Standard Contract, there will be a 12 month no fault termination clause.</p><p> </p><p>The Dudley MCP contract will ensure that in the event of a provider not meeting their obligations, and where there is a need for an early termination, the provider will be required to pay the commissioners any additional costs and expenses incurred as a result of the termination. This will include those incurred in recommissioning the services covered by the contract from an alternative provider for the rest of the term of the contract as well as ensuring service continuity.</p>

answer text <p>The Department expects clinical commissioning groups (CCGs) to assure themselves that they have satisfied their legal duties, including the need to consult local populations. CCGs have a duty to consult on their commissioning plans as set out in Section 14Z13 of the NHS Act 2006. The duty does not set any absolute timeframes.</p><p> </p><p>The Dudley CCG undertook a full public consultation last summer to inform the development of the Multi-speciality Community Provider contract. The consultation exercise reached out to several thousand people (including staff) and received over 600 contributions.</p><p> </p><p>A report was commissioned from ICF Consulting Services on the consultation process and considered by the CCG Board in September 2016. A copy of the report is available on the Dudley CCG’s website.</p> more like this
