The Government will do everything it can to encourage all coroners to make an out of hours service available and also to direct a less-invasive post-mortem where this is suitable and desired by the family.</p><p> </p><p>The Chief Coroner and I recently met senior figures from London local authorities and from the Metropolitan and City of London Police. The Transforming Summary Justice programme currently being rolled-out across England and Wales will ensure that cases set for trial in magistrates' courts are robustly case managed in advance of the trial date, reduce the number of unnecessary adjournments and increase the number of effective trials on the day.</p><p> </p><p>In current performance, overall, the last four years show an improvement in the time between the first listing of a case and its completion. I regret that it will not now be possible to bring forward the Code of Practice during this parliamentary session as we had previously intended.</p><p> </p><p>However, we do recognise the challenge which the outsourcing of public services poses for transparency. It is our wish that public authorities and their contractors should interpret their FOI obligations broadly, in a way which applies as high a level of transparency as possible, and takes due regard of the principles for public authorities required by the FOI Act. answer	answer is ministerial correction date of answer 26/02/2015 answer text <p /> <p>Providing support for young victims and witnesses in the criminal justice system is a matter the Government takes extremely seriously. There are a range of special measures in place to support them in giving their best evidence and to help to reduce the anxiety of attending court. This includes screens to shield the witness from the defendant, video links to enable victims and witnesses to give evidence away from the courtroom, the removal of wigs and gowns in cases involving children, and intermediaries to help vulnerable witnesses to give evidence in court. Victims of historical child sexual abuse will also be offered the support of a Registered Intermediary if they require support to communicate their evidence.</p><p><br> Publicly-funded defence advocates will in future be required to undertake approved specialist training on working with vulnerable victims and witnesses if they want to be instructed in sexual violence cases.</p><p>We have strengthened the Victims Code with a section specially written to support young people, and will enshrine in statute the right for a victim to make a personal statement and ask to have it read aloud in court before sentencing.</p> answering member constituency Hemel Hempstead answering member printed Mike Penning question first answered 26/02/2015 16:30:27 answering member 1528 label Biography information for Sir Mike Penning

answer	answer is ministerial correction date of answer 26/02/2015 answer text <p /> <p>I have interpreted this question as referring to cases in the criminal courts, and to costs relating to Her Majesty’s Courts and Tribunals Service (HMCTS).</p><p> </p><p>No estimate of the average annual cost of court cases involving children that collapse due to insufficient or unreliable evidence is available. HMCTS' case management systems do not record the age of victims and witnesses in all trial cases. The only way to obtain this information would be to manually check every trial case file at each magistrates' court and Crown Court centre and collate the data, which would incur disproportionate costs.</p><p> </p><p>Even if this data were available, this would not enable an estimation of the cost to HMCTS as the cost of a criminal case that does not proceed varies widely, depending on a range of factors including the point at which the case ‘collapses’.</p><p> </p><p>HMCTS is working closely with other criminal justice system agencies to ensure that cases that proceed to trial are effective, as well as to support children and other vulnerable victims and witnesses in giving evidence.</p><p> </p><p>HMCTS is, for example, piloting section 28 of the Youth Justice and Criminal Evidence Act 1999, a special measures provision allowing the cross examination of eligible witnesses’ evidence to be recorded in advance of the trial.</p> answering member constituency North West Cambridgeshire answering member printed Mr Shailesh Vara question first answered 26/02/2015 17:54:59 answering member 1496 label Biography information for Shailesh Vara
