answer text <p><del class="ministerial">There are no central records of the number of prisoners who have self-declared a transgender status. Individuals with a gender recognition certificate are recorded on administrative systems in their legal gender, and are not identifiable as having changed gender.</del></p><p /> <p><ins class="ministerial">In March, we announced a package of measures to ensure that the public was properly protected. Absconds and escapes have reached record lows under this Government, but we take each incident seriously. As a result of a comprehensive review, we have made major changes to tighten the eligibility for open prisons. Prisoners may no longer be transferred to open conditions or allowed out on temporary release if they have previously absconded, escaped, attempted to escape, or if they have failed to return or have re-offended whilst released on temporary licence, unless there are exceptional circumstances. </ins></p><p><ins class="ministerial"> </ins></p><p><ins class="ministerial">The change in policy for eligibility for open conditions was not applied retrospectively: the majority of these offenders who were already in open conditions were allowed to remain. However, any prisoners who were assessed to present an unacceptable risk in such conditions in light of their previous non-compliance were returned to closed prisons.</ins></p><p><ins class="ministerial"> </ins></p><p><ins class="ministerial">Progression to open prison is never automatic. All prisoners undergo regular, mandatory assessment of their risk of escape or abscond and risk of harm to the public. Only those who are assessed as having an acceptable level of risk for conditions of lower security can be allocated to open prison.</ins></p><p><ins class="ministerial"> </ins></p><p><ins class="ministerial">As at 31 March 2014, there were no prisoners held in open prisons who had absconded or escaped on more than one occasion between 1 April 2010 and 31 March 2014. </ins></p><p><ins class="ministerial"> </ins></p><p><ins class="ministerial">There were 13 prisoners who, in the year ending 31 March 2014, either escaped or absconded from prison, having previously done so between 1 April 2010 and 31 March 2014. </ins></p><p><ins class="ministerial"> </ins></p><p><ins class="ministerial">Data on escapes and absconds, prior to 1 April 2010 could not be obtained except at disproportionate cost due to changes in recording practice. </ins></p><p><ins class="ministerial"> </ins></p><p><ins class="ministerial">As part of business as usual, open prisons return prisoners to closed conditions where they judge that they can no longer be managed safely in open conditions. Figures for this ongoing process are not included here.</ins></p><p><ins class="ministerial"> </ins></p><p><ins class="ministerial">These figures have been drawn from administrative IT systems which, as with any large scale recording system, are subject to possible errors with data entry and processing.</ins></p>

answer text <p /> <p>Police, prisons and CPS work closely together at the local level to ensure that there is an effective criminal justice response to crimes in prison. The recently announced protocol on the appropriate handling of crime in prison is designed to ensure that there is greater consistency in approach across different regions.</p><p> </p><p>It is not possible to identify from centrally held data, the number of prisoners proceeded against since 2010 in respect of a serious crime committed whilst in custody. This information could only be obtained at disproportionate cost by asking individual prisons to liaise with police forces and examine their records for the period in question.</p> more like this

answer text <p /> <p>Individual policy Impact Assessments have been published where the amendments added to the Bill during its passage through the House of Lords would either lead to an impact of £5m per annum or more on the public sector, or are likely to attract high levels of political or media interest. These include individual Impact Assessments on provisions on the Recall Adjudicator for recalled determinate sentence prisoners, provisions which prohibit the offering of inducements or similar rewards as an encouragement to make a personal injury compensation claim and provisions relating to routes of Appeal in the Court of Protection</p><p> </p><p>These Impact Assessments are available here:</p><p><a href="http://services.parliament.uk/bills/2014-15/criminaljusticeandcourts/documents.html" target="_blank">http://services.parliament.uk/bills/2014-15/criminaljusticeandcourts/documents.html</a></p><p> </p><p>Following the Government’s recent acceptance of the Earl of Listowel’s amendment at Lords Third Reading in relation to the duties of custody officers after charges for arrested juveniles, an Impact Assessment will be published on this provision in due course.</p><p> </p><p>In relation to all other Government amendments made during the Bill’s passage, including disclosing private sexual photographs and films with intent to cause distress and youth reporting restrictions, our analysis is that the impact of these provisions does not meet threshold to require a full Impact Assessment.</p><p> </p><p>The Government’s overarching Impact Assessment for the Bill as a whole will be updated once the Bill achieves Royal Assent.</p>

answer text <p /> <p>The new package of support announced on 23 October is aimed at keeping disputes away from court, while those who end up in court will be provided with better support. The funding will be used to support a new strategic approach to increasing legal and practical support for litigants in person in the civil and family courts. This will provide direct support in some local courts, and other courts will be able to access national support via email or telephone. The service will begin in selected court centres with the aim of rolling it out across England and Wales.</p><p>This strategy has been developed in partnership with the legal and advice sectors and we are currently working with them on implementation. We hope to be in a position soon to make a decision on which courts will receive direct support as a result of the additional funding.</p> more like this
