	answer	answer is ministerial correction date of answer 22/01/2015 answer text <p /> <p> </p><p>The French Government and European Union law makes a distinction between the <em>pays et territoires d’outre-mer</em> (PTOM) and the <em>départements d’outre mer (DOMs). </em>The PTOM include Saint-Pierre and Miquelon, Saint Barthélémy, French Polynesia, Wallis and Futuna and New Caledonia. These territories benefit from association with the EU but community law does not generally apply. With the exception of Saint- Barthélémy they have their own social protection schemes and are legally and financially autonomous. UK Winter Fuel Payments are not paid to residents in the PTOMs.</p><p> </p><p>The French Government treats its DOMs as integral parts of the French State and they are subject to the application of EU social security co-ordination regulations. 	answer	answer is ministerial correction date of answer 23/01/2015 answer text <p /> <p>It is the French Government that defines itself as the mainland and its outermost regions, and as such are included in the EU social security co-ordination regulations, used and applied by all member states.</p><p> </p><p>It is because of this that the French Overseas Departments<em> (départments d’outre mer</em> or DOMs) are treated in the same way as mainland France with regard to Winter Fuel Payments, which are currently made to those entitled who live there. Therefore, the hotter French Overseas Departments have to be included in the calculation of the average temperature of France. The regulations establishing Winter Fuel Payments for 2015/16 will include the new eligibility condition. These regulations are made annually under the Social Security Contributions &amp; Benefits Act 1992, and those for winter 2015/16 will be made in the current Parliament.</p><p> </p><p>Since 1 June 2014, we have received two Parliamentary Questions, twenty one items of Ministerial or official correspondence and four Freedom of Information requests relating to the future of Winter Fuel Payments in France. A temperature criterion was introduced by the DWP using information from a report it commissioned from the Met Office. This report showed the average winter temperature data for each EEA country and Switzerland and for the regions of the UK. The Met Office report was produced in 2012 and used information from a dataset for the reference period 1961-1990 available through the Climatic Research Unit of the University of East Anglia.</p><br /><p>The average winter temperature in the warmest part of the UK, the South West, is 5.6<sup>o</sup>C. This point is the basis for the changes made to the winter fuel payment eligibility criteria.
