answer text <p>HMCTS welcomes the Equality and Human Rights Commission report on Inclusive Justice which brings the opportunity to review the report recommendations alongside the work already being progressed for supporting vulnerable defendants.</p><p>Under the HMCTS Reform Programme new systems are being developed to improve accuracy and consistency of data across the Magistrates’ and Crown Court jurisdictions, including data on disability.</p> more like this

answer text <p>The Ministry of Justice (MoJ) is committed to supporting all vulnerable people who come into contact with the criminal justice system. We recognise the importance of meeting the needs of this cohort, are therefore taking steps to improve data collection on disability.</p><p>This includes ongoing work by HM Prisons and Probation Service (HMPPS) to implement a new data categorisation list which aligns with that used by the World Health Organisation and the Government Statistical Service on the new Prison National Offender Management Information System (new-NOMIS). This will include a more complete list of conditions which will allow HMPPS to more accurately record impairments and support the individual needs of offenders.</p><p>Improvements have also been made in the breadth of data captured on NDelius, the probation case management system. Probation data collection covers the protected characteristics, and records specific conditions as narrative detail under broad headings such as Autism Spectrum Condition, Visual Impairment, Reduced Physical Capacity and others.</p><p>The MoJ is also committed to supporting staff with disabilities. The department is working to improve the robustness of employee disability data, and to record data with more accurate recognition of disability impairment types.</p>

answer text <p>COVID-19 has been an unprecedented challenge for the criminal justice system, but we have continued to deliver justice throughout. The UK has been a global leader and we are ahead of most comparable systems.</p><p> </p><p>Social distancing meant jury trials were paused, but the Courts did not stop. Across all Jurisdictions 159 Courts remained fully open to the public, and our ambitious use of technology has led to the Cloud Video Platform (CVP) being operational in over 100 courts, 90 police custody suites and 30 prisons, enabling us to conduct over 6,000 hearings on this platform. We will continue to roll this out at pace, and the benefits will be felt long after the pandemic has ended.</p><p> </p><p>HMCTS have worked hard to keep Courts open and jury trials have now resumed. HMCTS are pursuing an ambitious plan to continue to increase capacity. Throughout the pandemic, our priority has been protecting the public which is why we have made sure the most urgent cases, such as domestic violence and overnight custody cases, have been prioritised.</p>

National Statistics for the period up to December 2019 have been published at the same link. National Statistics on the level of outstanding work in the <strong>family and civil </strong>courts are not available.</p><p>In response to the level of the backlog in (b) tribunals in each region in each of the last six months, data for the period October 2019 to March 2020 is provided at <strong>Annex A</strong>. These figures represent the total number of cases outstanding in each jurisdiction. Official Statistics on the level of outstanding work in tribunals for the second quarter of 2020 are due for publication in September 2020 at the following link; <a href="https://www.gov.uk/government/collections/tribunals-statistics" target="_blank">https://www.gov.uk/government/collections/tribunals-statistics</a>.</p><p>Figures on the level of outstanding work at the national level in the largest jurisdictions across HM Courts &amp; Tribunals Service are published as monthly management information at the following link; <a href="https://www.gov.uk/government/collections/hmcts-management-information" target="_blank">https://www.gov.uk/government/collections/hmcts-management-information</a>. The exception to this is the civil courts, for which figures relating to outstanding work are not currently collated because a large proportion of cases that begin are subsequently settled out of court or discontinued without HMCTS being notified. The latest figures relate to April 2020 for most jurisdictions and March for the family courts.</p>

answer text <p>Information relating to the proportion of prisoners who were released from each prison without a fixed address between 2015 and 2016 could only be obtained at disproportionate cost.</p><p>The Government has now decided that because of public health and public protection considerations, there is a need to provide accommodation for prison leavers during the Covid-19 pandemic. The Ministry of Justice has secured appropriate funding for a time-limited period to support the provision of accommodation for all individuals released from prison during this period, who are at risk of homelessness. The temporary accommodation scheme will run until 26th June at which point it will be reviewed, taking account of the situation at that time. This is an exceptional measure reflecting the current challenges. Additionally, we are also working in collaboration with other government departments and interested parties to help to secure a range of accommodation options for prisoners on their release.</p><p>Whilst our immediate concern is to support those individuals released from prison into suitable accommodation, in the long-term we will analyse the lessons learned during this period, to further develop how we can improve the accommodation offer for those with a history of offending.</p>

answer text <p>As a Government, we have outlined the risks posed by the COVID-19 virus, and the control measures required to avoid exposure and transmission. In parallel, we have been clear that the work of the justice system must continue throughout the prevailing public health emergency. Accordingly, it has been necessary to keep some courts and tribunal buildings open, and we are working hard to open more so long as that can be achieved safely.</p><p>HMCTS is committed to ensuring the health, safety and welfare of all staff, members of the judiciary and visitors to its sites, as far as it is reasonably practical whilst they are on the premises.</p><p>In order to aid implementation of the required control measures, and to monitor and assure ourselves of compliance, we developed and implemented an assessment tool to be carried out in each of our open sites.</p><p>The tool was developed in consultation with trade union health and safety representatives. The finalised tool was issued to each site, with instruction that it should wherever possible be completed in conjunction and consultation with a Trade Union representative. I understand that wherever possible our officials did conduct those assessments with trade union colleagues, and continue to do so as the results are regularly reviewed.</p><p>We are confident that our open sites are safe, and can confirm risk assessments will be available to be shared on request very soon.</p>

answer text <p>A judicial led Jury Trials Working Group (JTWG) was set up to establish ways in which jury trials can be commenced safely. The JTWG developed a Crown Court Jury Trial checklist which was discussed with the Departmental Trade Union Side (DTUS) on 30 April and a copy shared with them on 4 May. Completed risk assessments were shared with the DTUS before the first jury trials resumed on 18 May.</p> more like this

answer text <p>HM Courts &amp; Tribunals Service has comprehensively assessed the risk to its staff and users. We have published and implemented safety controls to help prevent the spread of Covid-19.</p><p> </p><p>Face coverings are available on request for staff, judges and jurors. Personal protective equipment (PPE) is available to staff where local assessments show that this is necessary. In line with Government guidance, PPE will be reserved for those most at risk of close contact through their workplace, such as security officers involved in interventions, fire-marshals and first-aiders.</p><p> </p><p>We are keeping the use and distribution of PPE under close review and we will continue to ensure that we comply with Government guidance.</p> more like this

The evaluation report will be published following completion, in the autumn.</p><p>The evaluation is being conducted as set out in the evaluation plan, published July 2019: Data has been collected on the number of cases heard in Flexible Operating Hours sessions rather than on numbers of participants. Public user surveys distributed to all participants in an FOH sessions contained 19 optional questions related to equality and diversity. This information is being collected by the independent evaluators and will inform their final report.</p> more like this
