answer text <p>The Mental Capacity Assessment requires a two-stage test of capacity.</p><p><strong>Stage 1</strong>. Is there an impairment of, or disturbance in the functioning of a person's mind or brain? This could be due to long-term conditions such as mental illness, dementia, or more temporary states such as confusion, unconsciousness, or the effects of drugs or alcohol and</p><p><strong>Stage 2</strong>. Is the impairment or disturbance sufficient that the person lacks the capacity to make a particular decision?</p><p>The Mental Capacity Act says that a person is unable to make their own decision if they cannot do one or more of the following four things:</p><ul><li>Understand information given to them;</li><li>Retain that information long enough to be able to make the decision;</li><li>Weigh up the information available to make the decision;</li><li>Communicate their decision – this could be by talking, using sign language or even simple muscle movements such as blinking an eye or squeezing a hand.</li></ul><p> </p>

answer text <p>Sport and physical activity in prison can help to build prisoner’s confidence, provide purposeful activity and support engagement with rehabilitation when prisoners are preparing for release. There are measures in place to monitor the effectiveness and participation levels of physical education (PE) across the prison estate, and the standards of sports and activities are monitored by Physical Education Managers (PEM). I have attached available data in relation to prisoner participation levels over the last 10 years. Unfortunately, data for 2011 – 2012 is not available.</p><p> </p><p> </p><p> </p><p>Our response to Professor Rosie Meek's independent review of sport and physical activity sets out some of the work we are doing to improve provision of sport and physical activity education in the secure youth estate. That response can be found here: <a href="https://assets.publishing.service.gov.uk/government/uploads/system/uploads/attachment_data/file/733311/a-sporting-chance-govt-response.pdf" target="_blank">https://assets.publishing.service.gov.uk/government/uploads/system/uploads/attachment_data/file/733311/a-sporting-chance-govt-response.pdf</a>. Her Majesty’s Prison and Probation Service (HMPPS) also recently conducted a strategic review of PE in prisons which examined current delivery, and measured delivery effectiveness against specifications. It also considered how current PE delivery meets the needs of prisoners, staff, and the emerging requirements from prison reform initiatives. We hope to publish these findings in due course. HMPPS does not separately identify spending associated with sports programmes. answer text <p>The Government is committed to ensuring that victims of crime get the support they need to cope with and, as far as possible, recover from the effects of crime.</p><p> </p><p>Under the 2016-2020 Violence Against Women and Girls strategy, the Government made a commitment to maintain funding for sexual violence support services at 2016/17 levels for the remainder of the spending review period. We continue to meet this commitment.</p><p> </p><p>In 2017/18 we allocated around £7.2 million to Rape Support Centres in England and Wales, to provide specialist support to female and male victims of sexual violence. Rape Support Centres receive funding from a range of sources, including the government, Police and Crime Commissioners, charitable trusts and foundations, and the National Health Service.</p><p> </p><p>This year we have allocated Police and Crime Commissioners around £68 million to locally commission or provide support services for victims of crime based on need. This includes victims of sexual violence.</p><p> </p><p>The Government is considering long-term and sustainable funding arrangements as part of our work to develop a new delivery model for supporting victims and witnesses of crime. This work will form part of the Government’s Victims Strategy, to be published in Summer 2018.</p>

answer text <p>We are committed to ensuring that victims get the support they need to cope with and, as far as possible, recover from the effects of crime.</p><p> </p><p>Rape support centres are funded from a number of different sources, including the Ministry of Justice (MoJ).</p><p> </p><p>In 2017/18 the MoJ directly allocated around £7.2m as a contribution to 97 Rape Support Centres across England and Wales to provide independent, specialist support to female and male victims of sexual violence, including victims of child sexual abuse. An additional 4.1% uplift was also allocated to all rape support centres in recognition of the increasing demand for support.</p><p> </p><p>In 2017/18 the MoJ also allocated around £68m to Police and Crime Commissioners to locally commission emotional and practical support services for victims of crime, including services for victims of sexual violence.</p><p> </p><p>In London, 5 centres are part-funded nationally by the MoJ, including 1 centre in South London and Wandsworth.</p>
