There were 103 in 2010, 24 in 2011, 229 in 2012 and 496 in 2013, as stated in the reply of 17 June, Official Report, column WA38, given by the former Senior Minister of State for Foreign and Commonwealth Affairs, the right hon. Baroness Warsi. The Government cannot readily provide statistics for incursions before 2010 as this could only be obtained at a disproportionate cost.</p><p>Incursions are a violation of sovereignty, not a threat to it. They do not change the fact of British sovereignty over British Gibraltar Territorial Waters. answer	answer is ministerial correction date of answer 15/09/2014 answer text <p>Gibraltar forms part of the EU and the EU provisions on the free movement of workers, capital and services apply to Gibraltar. Spain is entitled to establish checks at the border with Gibraltar, but these checks must be proportionate and non-discriminatory in order to remain in compliance with EU law. Pursuant to its role as guardian of the EU treaties the European Commission has an important role to play in assessing whether Spain has complied with these EU law obligations. We have made consistently clear to the Commission that we believe Spain has breached EU law in this area and the Commission recently agreed that the checks giving rise to waiting several hours to cross the border were disproportionate.</p><p>Incursions by Spanish state vessels into British Gibraltar Territorial Waters raise issues under the international law of the sea rather than under EU law. We have made it clear to Spain that unlawful incursions are unacceptable. We have not asked the European Commission or any other Member State to take any specific action in relation to incursions into British Gibraltar Territorial Waters because they have no locus on this issue.</p><p>The main focus of our lobbying within the EU remains Spain’s unlawful, unjustified and disproportionate action at the border. The Government is pleased that a second border monitoring mission was sent to Gibraltar on 2 July 2014, following concerted lobbying of the European Commission. We have also been very clear to the Commission and other Member States that Spain’s attempts to suspend Gibraltar from EU aviation legislation are unacceptable. Friend the Member for Richmond (Yorks) (Mr Hague), suggested ad hoc talks, involving all relevant parties, to address practical issues (including the delays at the border) to the Spanish government in April 2012. We are actively discussing this proposal with the Governments of Gibraltar and Spain and hope it will be possible to hold talks soon.</p><p> </p><p>In the meantime, we are maintaining strong diplomatic pressure on the Spanish government to end disproportionate and unlawful checks at the border. answer	answer is ministerial correction date of answer 17/06/2014 answer text <p>The total number of unlawful incursions into British Gibraltar Territorial Waters (BGTW), from 2010 onwards, are as follows:</p><p>2010 – 103<br>2011 – 24<br>2012 – 229<br>2013 – 496<br>Jan-May 2014 – 185</p><p>During this period, the Spanish Ambassador has been summoned three times on incursions related matters – 15 November 2012, 19 November 2013 and 2 April 2014. The British Government cannot readily provide statistics for incursions into BGTW by Spanish State vessels before 2010. This could only be obtained at a disproportionate cost. The Government upholds British sovereignty over BGTW by challenging and protesting unlawful incursions.
