answer text <p>Officials in my Department have regular discussions with the Department for Transport on a range of issues that impact on local authorities, including the proposal that all new streetlights should incorporate vehicle charging capability and the financial implications for local authorities.</p><p>The proposed policy ambition for all new street lighting columns, where appropriately located, to include charging provision, was consulted on publicly. Grant funding is available for local authorities to install lamp post charging solutions via government’s On Street Residential Charging Scheme</p> more like this

answer text <p>The ban on letting fees in Scotland was clarified in 2012. The private rented sector in Scotland has continued to grow and in 2016 made up 15 per cent of households compared with 13 per cent in the 2012 Scottish Household Survey. The Scottish Government estimate the number of letting agents currently operating in Scotland is around 1,700. This demonstrates that good and innovative agents will continue to have a market in which to thrive.</p> more like this

answer text <p>It is very difficult to understand the direct impact of the ban on fees on rental levels in Scotland since there are many different economic factors to take into account. Rents have risen on a cumulative basis no faster in Scotland since 2012 than in England and the sector remains healthy. According to ONS data, between 2012 and 2018, rents increased on average by 12 per cent in England compared to 6 per cent in Scotland.</p> more like this

answer text <p>The Local Government Boundary Commission for England may undertake a boundary review following a request from the councils concerned, the Secretary of State, or on its own initiative. Our policy is that all local government structural or boundary changes should be locally-led, and hence it would not be appropriate for the Secretary of State to request a review of the boundary between Lewes District and East Sussex County Councils, and Brighton and Hove City Council – any such request should be made by the councils concerned.</p> more like this

answer text <p>The ability to create, amend or abolish parish and community councils was devolved to local government by the Local Government and Public Involvement in Health Act 2007. Central Government therefore has no remit for involvement in such an issue.</p><p>However, as a local matter, the parties concerned should contact the Local Government Boundary Commission for England, which has powers to recommend boundary changes between principal local authorities, and consequential changes to parish arrangements to the Secretary of State. A review of this kind is known as a Principal Area Boundary Review (PABR).</p><p>The Commission’s current policy is that it would only agree to carry out a PABR if there was support from all authorities involved in the potential boundary change, that the proposal represented value for money for local taxpayers and there is evidence of public support for the proposition.</p><p> </p> more like this

answer text <p>Second homes are liable for council tax, not business rates. However, where a property is available for letting commercially for short periods totalling at least 140 days per year, then it will be assessed for business rates and added to the business rates list. As of June 2018, there were 47,307 holiday lets liable for business rates in England. The table below provides the figures by local authority. Small Business Rate Relief provides 100 per cent relief from business rates on properties with a rateable value of £12,000 or less, provided the business uses only one property (though relief may still be available under certain circumstances). The Department does not hold information on the number of recipients of Small Business Rates Relief by type of property.</p><p>The 140-day rule is widely understood and provides a clear and stable method of deciding whether a property should be liable for council tax or business rates. In particular, it ensures that properties do not switch year-to-year between council tax and business rates merely due to success in letting out the property. It is right that genuine holiday lets, many of which are small businesses, should be able to apply for Small Business Rate Relief.
