answer text <p>The off-payroll working rules (sometimes known as IR35) have been in place since 2000. They ensure that individuals working like employees pay broadly the same amount of tax and NICs, regardless of the structure they work through. They do not affect the self-employed.</p><p> </p><p>In 2017 the Government reformed the way the rules operate in the public sector to address widespread non-compliance. This shifted responsibility for determining whether the rules apply from contractors to the bodies that engage them. Evidence shows that compliance is improving without reducing the flexibility of the labour market.</p><p> </p><p>Budget 2018 announced that the reform would be extended to all sectors, but not until April 2020 in order to provide more time for businesses to prepare. Small businesses have been excluded from the scope of the reform.</p><p> </p><p>The change will improve compliance with the existing rules. Those who are compliant will feel little impact.</p><p> </p><p>The Government has consulted extensively on the reform. HMRC have published guidance on how businesses can prepare ahead of April 2020, and is rolling out an education and support programme to help organisations make the right decisions.</p><p> </p><p>Information on the number of people within scope of the off-payroll working rules is not held at constituency or regional level.</p>

answer text <p>At present there is no direct link between employment status for rights and employment status for tax.</p><p> </p><p>Those who wish to challenge their employment status for rights can take their case to an employment tribunal, regardless of their tax status. In order to modernise and enhance the enforcement of the employment rights for workers, the government is currently consulting on the proposal to introduce a new single enforcement body for employment rights. The government is also consulting on strengthening enforcement and extending entitlement to statutory sick pay.</p> more like this

answer text <p>This information is only available at disproportionate cost.</p><p>HM Revenue and Customs (HMRC) do not routinely collate the number of tax avoidance schemes related to the use of personal service companies.</p><p> </p><p>HMRC publishes information regarding the number of tax avoidance cases challenged in court by taxpayers in their annual Tax Assurance Commissioner’s Report. At the same time, HMRC publish a list of tax avoidance litigation decisions handed down during the period. The Report for 2018-19 is due to be published before the summer recess.</p><p> </p> more like this

answer text <p>A consultation on the detail of extending reform of the off-payroll rules closed in May and the Government will publish its response in due course. The Government is considering the responses to that consultation, which will be taken into account in the design of the draft Finance Bill legislation which will be published on 11 July.</p><p> </p><p>The off-payroll working rules (commonly known as IR35) are designed to ensure that individuals who work like employees pay broadly the same income tax and national insurance contributions (NICs) as employees, regardless of the structure they work through. The rules have been in place since 2000.</p><p> </p><p>HMRC data shows non-compliance with these rules is widespread. To address this, the Government is extending the previous reforms for the public sector to all medium and large organisations from April 2020. This reform will ensure better compliance with the rules. It does not introduce a new tax.</p><p> </p><p>HMRC have measured the impact of reforming the off-payroll rules in the public sector and estimate the reform has already raised an additional £550 million in income tax and NICs in the first 12 months since it was introduced. HMRC also published independent research into the impact of these reforms in May 2018.</p>

They are designed to ensure that individuals pay a fair amount of tax and NICs, regardless of the structure they work through. They do not affect the self-employed.</p><p> </p><p>To address widespread non-compliance, the rules were reformed in the public sector to shift responsibility for assessing the individual’s employment status from the individual’s company to the public authority. The Government has monitored the public sector reform of the off-payroll working rules through independent research, engagement with the public sector and analysis of HMRC data.</p><p> </p><p>Evidence shows the changes are having the desired effect. Compliance is increasing, with an estimated £550 million in additional employment taxes being raised over the first 12 months without damaging the flexibility of the labour market.</p><p> </p><p>Following consultation, the Government announced at Budget 2018 that it will extend this reform to all medium and large organisations.</p><p> </p><p>The Government listened to stakeholder views during the consultation, and decided the reform will not apply to the smallest 1.5 million businesses. Large and medium businesses will have longer to adjust, with the changes being introduced in April 2020. There are no plans to delay implementation beyond that date.</p><p> </p><p>The Government consulted on the detailed operation of the reform earlier this year, and met over 100 affected businesses and their representatives. The Government is considering the responses to that consultation and will publish its response in due course.</p><p> </p><p>The Government recognises the importance of contracting and the flexible economy. The off-payroll working rules do not affect the self-employed and will not stop anyone working through a company.
