answer text <p>The public consultation, <em>A new legal framework for abortion services in Northern Ireland</em>, provided an opportunity for people and organisations in Northern Ireland to contribute their views on how the Government could best deliver on its statutory duty under section 9 of the Northern Ireland (Executive Formation etc.) Act 2019 in implementing the CEDAW Report recommendations. <br> <br> The Government engaged with a wide range of stakeholders who reached out seeking further discussions during the consultation process. However, the consultation process did not collect personal data that would identify a respondent as a person with a disability. We carefully analysed all of the views expressed in the submissions received.</p><p> </p><p>It is the Government’s firm view that the Regulations properly comply with the statutory duty under section 9 of the NIEF Act, and are also compliant with the UK’s obligations under the United Nations Convention on the Rights of Persons with Disabilities.</p>

answer text <p>Limited Early Medical Abortion (EMA) services are currently provided in Northern Ireland, but these fall short of the services that the Secretary of State for Northern Ireland instructed the Northern Ireland Department of Health (DoH) to provide by March 2022. We are disappointed that the Executive has failed to provide services. As set out in his recent Written Ministerial Statement, the Secretary of State is committed, if necessary, to make regulations and directions to ensure abortion healthcare is delivered in Northern Ireland.</p><p> </p><p>Information on the location of surgical abortions performed in Northern Ireland is held by the DoH. The latest publicly available data shows that between 1 April 2020 and 31 January 2022, a total of 2,794 notifications of termination were submitted to the Chief Medical Officer in Northern Ireland.</p><p> </p><p>The most recent data published on women resident in Northern Ireland travelling to Great Britain for an abortion procedure is from 2020, where the number of women and girls travelling to England for abortion services was 371.</p>

answer text <p>The Department of Health and Social Care has now published the 2020 statistics on abortion in England and Wales. In 2020, there were 371 abortions in England and Wales for women from Northern Ireland.</p><p> </p><p>I would note that over 1,100 women and girls have been able to access local abortion services since April last year - and this should not be overlooked at a time where the services have not been formally commissioned. It is, however, very distressing to hear that even throughout the Covid-19 pandemic, some women and girls have still been forced to travel, at a time where it is even more crucial for local access to healthcare to be available. We put on record our thanks to the medical professionals who have ensured that women and girls have had some access to abortion services in Northern Ireland to date, and the organisations that have supported this work.</p><p> </p><p>However, progress must be made towards properly commissioning services so that safe, local abortion services are fully available as a healthcare service in Northern Ireland. The current situation is not acceptable. If there continues to be no progress, the Secretary of State for Northern Ireland will issue a direction using his powers under the Abortion (Northern Ireland) Regulations 2021, to ensure that services are commissioned and delivered according to the 2018 Report of the Convention for the Elimination of Discrimination Against Women.</p><p> </p><p> </p><p> </p>

answer text <p>The health and safety of women and girls, and clarity and certainty for the medical profession, is at the forefront of the Government’s approach in complying with the legal duty under section 9 of the Northern Ireland (Executive Formation etc) Act 2019.</p><p> </p><p>As the duty has now come into effect, there have been some immediate changes to the law in Northern Ireland. We do not expect there to be any additional services available ahead of the new legal framework being in place by 31 March 2020. It is important that we get the legal framework right and are confident that service provision in Northern Ireland can meet women and girls’ needs.</p><p> </p><p>In the meantime, women and girls resident in Northern Ireland will be able to continue to access services in England, with all costs of the procedure, including travel and, where needed, accommodation, being paid for from 22 October 2019.</p><p> </p><p>Healthcare professionals who have a conscientious objection should follow guidance from their professional body. We recognise that this is a sensitive issue, and consideration is being given to providing for conscientious objection in the new legal framework for access to abortion in Northern Ireland.</p><p> </p><p>The Government will be shortly consulting on this proposed framework.</p>

answer text <p>Clinics run by Marie Stopes International (MSI) continue to be registered with the Care Quality Commission (CQC) and approved by the Secretary of State to perform abortions. We are aware that CQC inspections raised serious concerns about compliance by MSI clinics with requirements set by the Department and the CQC. MSI are continuing to take a range of actions to address the issues identified in the CQC’s reports. The CQC re-inspected MSI earlier this year and has made clear that they will not hesitate to take further action if necessary, in order to guarantee MSI meets the standard of care they expect and that its patients deserve. The Department continues to closely monitor the situation with particular regard to the statutory approval responsibilities of the Secretary of State.</p> more like this

answer text <p>We estimate the cost of providing termination of pregnancy services in England to women from Northern Ireland to be in the region of £1 million per year. The provision of antenatal and maternity services in Northern Ireland is a devolved matter. The decision to provide such funding is separate from issues about support for other groups of pregnant women and there is no necessary connection between the two matters.</p><p> </p><p>The Supreme Court in R (on the application of A and B) v Secretary of State for Health (2017) found that the Government has the power to fund abortion services in England for women lawfully resident from Northern Ireland.</p> more like this
