star this property answer text <p>The appropriate route to challenge a conviction and/or sentence is by way of appeal.</p><p> </p><p>Anyone who has been convicted of a criminal offence in England, Wales or Northern Ireland can apply to the Criminal Cases Review Commission, which can review and investigate possible miscarriages of justice. Where there is a real possibility that the conviction or sentence will not be upheld, the Commission can refer the case to the appropriate court.</p><p> </p><p>For the Commission to refer a case there normally needs to be significant new evidence or issue that might affect the safety of the conviction or sentence.</p> more like this

star this property answer text <p>We have been clear that probation needs to improve and have taken decisive action to end current CRC contracts and develop more robust arrangements to protect the public and tackle re-offending.</p><p> </p><p>We have seen examples of good and innovative work from CRCs. In Cumbria, adapting probation to a rural setting and in London, working with the Mayor’s Office on programmes to rehabilitate offenders involved in knife crime.</p><p> </p><p>I still believe that public, private and voluntary organisations all have a role to play. The reforms we are making are crucial to better integrate the system so that different providers can work more effectively together. We will set out our proposals later this year.</p> more like this

star this property answer text <p>We are looking to take forward reform of short custodial sentences. We know that offenders serving short sentences often have long offending histories, as well as multiple and complex needs. In cases of the most persistent offenders, the evidence shows they are 36% more likely to re-offend where they have received a short custodial sentence rather than a court order. Community penalties can address underlying behaviour, answer mental health and alcohol or drug misuse needs and provide reparation for the benefit of the wider community.</p> more like this

star this property answer text <p>The CRC Contract Management Group in the HM Prison and Probation Service (HMPPS) Directorate of Community Interventions is responsible for managing the 20 CRC contracts in England. The Group currently operates with an annual budget of £5,302,127, and 80.19 Full Time Equivalent (FTE) staff.</p><p> </p><p>Contract Management of Wales CRC is the responsibility of HMPPS in Wales, and currently employs 4.25 FTE staff for this purpose, with an annual budget of £233,000.</p><p> </p><p>The contracts with CRCs require each CRC to ensure that it employs a sufficient level of staff, and that its workforce is competent and adequately trained. Our CMTs closely monitor and robustly manage providers on a local basis, taking into account the regional context, to make sure they fulfil their contractual commitments to reduce reoffending, protect the public and provide value for money to the taxpayer.</p> more like this

star this property answer text <p>As at 31 December 2017, the latest published figures, there were 84,373 persons detained in prisons and the HM Prison and Probation Service run Immigration Removal Centre. Of these, 716 were recorded as Albanian nationals. Albanian nationals represent 0.85% of the total prison population.</p><p>Any foreign national who comes to our country and abuses our hospitality by breaking the law should be in no doubt of our determination to deport them. More than 40,000 foreign national offenders have been removed from the UK since 2010, with a record number of over 6,300 removed in 2016/17.</p><p>A Prisoner Transfer Agreement is in place between the UK and the Republic of Albania, and we are working closely with Albanian authorities to speed up and significantly increase transfer rates.</p> more like this

star this property answer text <p>The MOJ has no procedures in place for offenders to be tagged by police services during the covid-19 outbreak. The tagging of offenders released from custody as a requirement of a licence or subject to court imposed electronic monitoring is carried out by the Electronic Monitoring Service (EMS) not by police services during the covid-19 outbreak or otherwise. EMS is continuing to fulfil all the tagging requirements that it is responsible for and its staff have been designated key workers as their work is essential to the running of the justice system.</p><p> </p><p>Those being released under the End of Custody Temporary Release scheme, which has been established for low-risk offenders within two months of release, as part of the national plan to protect the NHS and save lives, are being fitted with a GPS tag on release and are subject to conditions requiring them to adhere to a curfew and the Government’s Covid-19 measures.</p> more like this
