star this property answer text <p>A review of the standard method formula was undertaken in 2020. As part of the consultation, we asked if we should incorporate more recent household projections data into the formula. Following careful consideration of the responses received, to provide stability and certainty for local authorities and other stakeholders we decided to retain the existing formula.</p><p>We have kept the standard method under review. Through a consultation on changes to national policy held in 2022/23 we committed to review our approach to assessing housing needs once new household projections data, based on the 2021 Census, is released in 2025.</p> more like this

star this property answer text <p>The Government continues to put extreme pressure into ensuring more fair and proportionate premiums for leaseholders living in multi-occupancy buildings with fire safety issues.</p><p>The FCA recommended that the insurance industry develop a risk-sharing facility for buildings with fire-safety issues. The Association of British Insurers’ Fire Safety Reinsurance Facility launched on 1 April 2024 in response to this recommendation. We are closely monitoring the Facility to understand the extent to which it improves outcomes for leaseholders.</p><p>On 31 December 2023, FCA changes came into force to give leaseholders rights under Fair Value rules and require the disclosure of key policy information. We welcome these changes and expect that they will help reduce the unfair costs facing leaseholders.</p><p>On 27 November 2023, the Leasehold and Freehold Reform Bill was introduced into Parliament. The Bill bans insurance commissions being passed to freeholders and managing agents, replacing these with transparent handling fees. This will stop leaseholders being charged excessive and opaque commissions on top of their premiums.</p><p>The Government has also published a commitment by 14 insurance broker companies to cap their commissions to 15%, stop sharing commissions with managing agents, landlords and freeholders, and share policy information with leaseholders when requested. The pledge will benefit leaseholders in buildings over 11 metres (or four storeys) in height with identified fire safety defects, where these details have been made known to the insurance broker.</p><p>We will continue to monitor the impact these changes have had on leaseholder premiums, and will remain engaged with industry regarding whether any further steps may be required.</p>

star this property answer text <p>The Government committed during the passage of the Levelling-up and Regeneration Act 2023 to consult on whether water companies should become statutory consultees on certain planning applications, and if so, how best to do this. The Secretary of State has since commissioned Sam Richards to undertake an independent review of statutory consultees within the planning system and the recommendations from this will be published in due course.</p><p>In the meantime, it is important that water companies engage local planning authorities on their applications at the right time so they can input effectively and not slow down the application process.</p> more like this

To date, no cladding or insulation manufacturer has come forward with a financial contribution for their part in this. We are continuing to press the industry on this issue.</p><p>The department’s Recovery Strategy Unit continues to actively pursue organisations, including manufacturers, responsible for unsafe buildings to force them to contribute to the costs of remediation.</p> more like this

star this property answer text <p>The department has applied for remediation contribution orders relating to building safety works against three companies, specifically:</p><ul><li>£20.5 million from Yianis Group for Canary Riverside</li><li>£46 million from Urban Splash for seven buildings in Manchester. These are: The Box Works, Burton Place, Chips Building, Christabel, Emmeline, Sylvia and Moho Building, all in Manchester</li><li>£3.4 million from Hollybrook for one building in London</li></ul><p>The aim of these orders is to recoup as much of the costs related to building remediation as possible, regardless of the organisation or individual who made the original payment. This could include, for example, the cost of waking watch, replacement of balconies or associated enabling works. <br> <br> Where costs are recovered through the First Tier Tribunal decision, be they all or part of those requested, the intention is they are refunded to whichever organisation or individual paid for them, whether taxpayer, leaseholder or otherwise. The action also aims to prevent leaseholders from having to pay costs for works not yet completed, including where leaseholders are non-qualifying.</p>

As I reiterated to the house on 26th March, and in a joint statement with building safety bodies, where building owners are stalling, they can expect to be subject to enforcement action by a local authority, fire and rescue service or the Building Safety Regulator.</p>

star this property answer text <p>There are currently three independent schemes that provide validation assessments for building control inspectors, which are now needed to register with the Building Safety Regulator for classes 2 to 4. The validation schemes run by the Building Safety Competence Foundation opened in 2022, while the other two schemes (run by Total Training and CABE) have been operational since 2023. All of the three schemes are independent of Government, and as the requirement to register with the BSR and undertake validation assessments only commenced on 6 April 2024, the department does not hold data that allows for comparison of fail rates over the past three years.</p> more like this

star this property answer text <p>To join the Fire Risk Assessor Panel firms must sign a participation agreement which sets out the terms for the panel and eligibility criteria. Along with agreeing to follow Homes England processes set out in the scheme guidance and use the correct scheme documents, firms must have:</p><ul><li>Relevant professional qualification to undertake fire risk appraisals as per PAS 9980 guidance</li><li>Access to chartered engineers to perform complex assessments when needed</li><li>ISO 9001 approach to quality control</li><li>Professional Indemnity Insurance</li></ul><p>Membership is renewed annually with firms having to provide evidence of their PII insurance and self-certification of qualifications and experience of firm assessors. The use of PAS 9980 and proportionality is assured by sample audit.</p><p>Since the scheme went live, four firms have left the panel through their own accord. Two pulled out due to resourcing issues and their inability to commit to meeting service level agreements and two others left due to them not receiving any business from being on the panel.</p><p>To date, Homes England have not had to remove any firms due to performance however Homes England can exercise this option should they need to.</p>

star this property answer text <p>The costs of remediation will only fall on leaseholders in the event some or all of the leaseholders choose to buy the freehold collectively and take over the rights and responsibilities of being the freeholder. Otherwise, the responsibilities will remain with the freeholder or, following the conclusion of any insolvency proceedings, with the party who acquires the freehold following termination of the insolvency. In which case, the leaseholder protections will apply.</p><p>As a result, qualifying leaseholders under the leaseholder protections in the Building Safety Act 2022 will remain protected in law from the costs of non-cladding historical safety defects being passed on to them through the service charge (under the terms of the protections).</p><p>Should a building owner become insolvent and enter administration, interested parties including leaseholders can also potentially look to pursue a previous freeholder, developer and any associated company or person for remediation costs through a Remediation Contribution Order and also have the potential to pursue developers, contractors or manufacturers where they are liable for defects which meant one or more dwellings in the building was not fit for habitation when the relevant works were completed.</p>

star this property answer text <p>National planning policy makes clear that local authorities should prepare their own local design codes in line with the principles set out in the National Design Guide and National Model Design Code, which can define what well-designed new development means in their local area.</p><p>The NPPF and supporting National Design Guide and National Model Design Code emphasise that effective engagement between local authorities, communities, applicants and other interests, such as architects, throughout the design process, including the preparation of design codes, is helpful to achieving well designed and sustainable new development.</p> more like this
